Mag asked lang po sana kame pano kame makakakuha ng legal separation certification?at anu mga requirements sa pagkuha nito. please po guide us.

Hi Runabel.

You have to file a Petition for legal separation in the Family Court where you or your spouse has been residing for at least 6 months. It should be filed within 5 years from the time of the occurrence of the ground to be used for the petition.

Upon filing of the petition, it is mandatory to give 6 months to the parties for them to try to save their marriage. If marriage was not saved after the 6 months, only then will the case proceed.

It is required to file a petition containing documents that can support your petition, i.e. marriage certificate, birth certificate of child/ren, titles to property, etc.

Time depends on the availability of the court that will handle the case.
