Can you please give me advice on this matter: Below is the statement of the contract to sell w/ in the first line of the paragraph the seller has changed the word inclusive into exclusive with a liquid erasure without notice to the buyer or nor any countersigned made. But on the next sentence the statement remains that the seller should borne all the aforesaid expenses...as we ask the agent they said that it is now exclusive due to change of promo. Thank You!

here is the statement in the contract:

The CONTRACT PRICE is inclusive of taxes, registration fees, permit fees and other expenses that are imposed or may be imposed on the PROPERTY or are necessary to effect and purchase thereof or of the title of the PROPERTY to the NAME of the BUYER. The aforesaid expenses shall be borne by the SELLER.

lemvanj,

what did you agree upon? when was the alteration or change made?

if you agreed that its "inclusive" and the alteration was made after the signing of the contract and without your consent, then you should not be made to pay for those expenses later on.

otherwise, this apparently contradictory stipulations may pose a problem in the future when you have fully paid the price and about to transfer the title. the sea of difference between inclusive and exclusive is a considerable amount of money.

Thank you atty. for your answer it means a lot to us as BUYER... We don't remember that it has erasure from the moment we signed the contract. And another thing is that we are not satisfied that the lot area and the floor area has discrepancy that's why we are requesting for the blueprint of the house but they said it cost 1, 000 pesos per page then we found out that it cost more or less 1, 500.00 only all the 11 pages. As much as possible we don't want to put this in a legal way because we are far abroad but they are giving us too much stress.
