Yes i understand that proof of sexual intercourse is a pre requisite> but if there is no child and of course no pictures that you are actually doing it. Would email correspondence be sufficient to file a case? is going out with a married woman grounds for them to file a case?

Not possible! Emails correspondent is not enough proof. You need to have a solid evidence that they had sexual intercourse. Shocked

emails are admissible evidence but only if it can be shown they were acquired without a violation of privacy of communication. it is very difficult to prove adultery; it's either you or some other witness sees them in the act or they have a child.

Thanks everyone. appreciate the comments. I have been getting threats because the girl's email was hacked and some email exchanges were seen.

Since the guy is wealthy and is capable of hiring private invetigators - does anyone know of cases that prosper due to this types of evidence.

I got pictures of my wife from her cellphone lying together with other men. I have 2 sets of pictures. One with the man sleeping and my wife beside him taking their pictures together and the metadata shows it's early in the morning. Also the pictures were taken on different dates.

The other set with another man shows them lying together in bed and are embracing each other, although dressed but on 2 consecutive days.

When I confronted her, she admitted in our IM's that indeed he had had sex with the first man a number of times but she tells me the 2nd man she just used to ward away the first.

Can I use these pictures together with the IM's as evidence? Would it stand in court? I may be able to produce witnesses that my wife regularly goes to the first man's house.

If properly documented and presented, Yes. Also, you have to show that you didn’t obtain the pictures illegally. Because as you said, you got the photos from her cellphone. Without her permission, that is a violation of her rights to privacy.

yes that can be evidence, but there will be challenges on how to present it in court later on.
