Dear Moderator:

I would like to seek legal advice due to my situation. Last 2008 I have used my credit card (BDO) to pay for my mother's hospitalization and also her funeral services. After which time i have been religiously paying my credit balance until such time that the minimum amount reached an amount that is beyond my capacity to pay for which last October 2009 i have faxed as per advised by their Customer Service a letter requesting for an amnesty or settlement of my said credit card balance because i will not be able to pay anymore the next monthly bills. Unfortunately, despite my efforts they have not taken any action on my request not until January 2010 in which people from the collections department have been talking to me. I have been asked to apply for a restructuring program by an collection officer/agent which i have accepted and I also tried to haggle with them the amount to be paid monthly but they have said that the minimum amount would be a fixed rate of Php 2,960+ monthly payable in 3 years. Due to my desire to resolve this problem i have agreed to their terms and faxed the application and other requirements. The collections officer even asked me to pay Php 5,000 as initial payment which i did through the bank. But a month later, February 2010, the same collections officer/agent told me that my application has been denied because I do not have a stable income and it is too low, and they see me unfit to pay the said amount and offered me to find a co-maker to sign in for the restructuring. I have no close relatives and my friends do not wish to sign up for such due to the legal consequences involved. A letter from a certain lawyer was also sent to me requesting me to accept the BDO collections offer which they themselves denied. I even called the law office to confirm to whom i should really coordinate and they have referred me to the the collections officer/agent of the bank. When i last spoke to the collection officer/agent she told me to reapply for a restructuring program with a co-maker which i explained that i could not provide and that i should pay another sum of Php 4700 as initial payment again but i was only able to pay Php 3000 due to the lack of funds. She told me that it is unacceptable and that i should pay the amount they are requesting me. Furthermore, that same collections officer/agent called my neighbors house and left her name and number there which ive read is possible already a violation of the unfair collection practices because they have divulged my financial issue and called a number which i have not disclosed to them because it is not mine in the first place. Also, the last time i spoke to that officer she even told me that its either i get a co-maker or i find a better job because i am only doing part time since i am a bit overage to be applying for a regular job and in my profession, being a registered nurse, volunteer jobs are only available at the moment. I have told her that i have been cooperative and have constantly communicated with them but they have been giving me a hard time. This issues has affected me physically, emotionally and also affecting my quality of work in my parttime job. I am requesting for an advice for the best action that i should take so that this problem can be resolved as soon as possible. I am literally alone since i am single and have no one else to turn to.
