Good Evening.

There are supervisors in our company that a manager complained as providing wrong information to their staff about managements direction and organizing them against the manager. There are no solid proof but the atmosphere in the department proves the manager's suspicion. We are afraid the problem is no longer healthy for anybody and afraid that it might escalate to something we can no longer remedy.

The said employees have been in the company for more than five years now and has established a relationship with our client by providing information of our company's every directions and decisions.

Is there a solid stand in terminating the supervisors on premise of loss of trust and confidence and what would be the legitimate process?

Will appreciate any advise you can provide.

Thank you.

hi. I would like to know the in-depth meaning of "position of responsibility, trust and confidence." How can you say that someone is holding the position of responsibility, trust and confidence and in what sense that someone doesn't hold the said ""position""?

it depends upon the Company.there are Company's held in favor for their Supervisors, esp supervisors against's casual or probationary employee's. I have an experienced before, what i did was i make AWOL on the company....

How about if there's proof of inefficiency (coaching)and abuse of position (complaint)? Staff has made complaints that they dont appreciate the supervisors favorite line whenever he does not get what he wants "gusto mo ngayon din tanggalin kita". Whenever the supervisor is asked to do a job the supervisor will always claim that he is loaded with work (rank and file work). Manager has been doing all his work and he then again received another complaint from staff that supervisor is using facebook while on duty.

If he is inefficient as a supervisor and performing the task of a rank and file can we just remove the position and put him back as a rank and file staff? Anyway the manager claims that he survived doing his and the supervisors work.

let's put it this way. if he files a case in nlrc, will your termination withstand legal scrutiny?

You're right but that doesn't make it any less sad...I guess we are stuck with him. Thank you so much. If not for your advise we would have made a terrible mistake.

God bless.

that doesn't mean you cant discipline him, but perhaps not terminate him (yet)
