I have an ongoing NLRC case wherein I asked for reinstatement citing that the relationship between me and my direct supervisor is not totally strained. The decision to terminate my employment was merely the decision of our HR manager.
I was surprised all of a sudden that my former supervisor messaged me saying that her job is in jeopardy and that it seems the company has lost confidence in her just because she was still communicating with me after I was terminated. I also asked her for a recommendation letter since I was seeking employment from another company although she agreed, she has not given me any physical letter.
My questions are:
1. Can this be cited in our 2nd conference citing that the HR manager could have fabricated a story so that my supervisor and I would have strained relations. Would this have any weight or relevance to my case since the HR Manager clearly has bad faith in her actions
2. Can they terminate her based on her actions of asking me how I was doing and willingness to give me a recommendation letter?
