Estafa for falsification of Documents

Hi! I am so glad to have found this site. A close friend of mine needs a legal advise.

Carlos, my friend, was married in 1974 but separated from his wife last 1985. After the separation, he was able to find a girlfriend who also worked in the same company he was working. What happened was, their personnel was questioning them about the morality of their relationship. The girl knew that he was married. So what they did was they got a "faked" marriage in 1991 ( Carlos was still very married with his first wife). The marriage certificate that they got with his new girlfriend was never entered in the civil registry. They only used it to show in their company that they were actually married and that there shouldn't be a moral issue. They had 2 sons. But their relationship didn't last. They broke up 2006.

The girl got married last year with another guy. And Now she is suing my friend for estafa....Can she sue estafa even though she knows that the guy was married. But in her demand letter, she stated that she only knew that he was married just lately.

Please advice.

estafa for what?

She filed a case for estafa due to the statement of Carlos ( as single and not married) in the Marriage license and certicate they got "which were not geniune".

But the truth was, they only got it not to show her that he is single but only to cover her reputation at work. They had to show the HR that they were married....both of them agreed to have that kind of document.

i don't think those are grounds for estafa. perhaps falsification of pub doc.

What is then is a good defense for that?
