I asked permission from my manager.
Pinayagan nya ko umabsent nung Dec13.
Then nung nagpaalam ako ng Dec16,
Sabi nya, wala na daw sya magagawa.
At tinanggal nya na ko.
Then after that, I asked him if makukuha ko pa ba last pay and 13th mo ko.
Sabi nya oo. After ko magpaclearance.
Pero pagpunta ko ng HR, AWOL daw ako at wala makukuha.

If you're terminated, you can still report to DOLE to contest that its too harsh to be terminated with your first offense. Do not burden yourself to look over with new and old version of handbook.

It is a practiced of some companies including yours not to give backpays to erring employees.
But remember that's their tactics only, but you can file money claim sa DOLE (SENA).

By doing this, you will force your HR to release your backpays.
Papipiliin mo ang HR mannager nyo, magrelease ng kusa o sa DOLE sya mag iissue ng cheke?
Mpahiya pa sya sa DOLE.

Its a matter of kaliwaan.

At yung sahod ko parang mafafall dun sa "40k" na dapat naming bayaran if ever mag AWOL kami. (Ayon sa contract)

Hi all,

Just want to get your legal opinion, if Management will issue Disciplinary Actions for those employees who did not report for work during Legal Holidays ( Dec 24, 25 , 30 & Jan 1), since this is their regular work day (based on our company calendar). Other employees who were asked to report for overtime also during holidays & failed to report on those  dates likewise were reprimanded for Failure to render Overtime. We are a manufacturing company and most of the holidays 80% of our manpower are required to report even on Holidays. Thanks !

If it is deemed necessary for the operations, and you are given the holiday pay required by law, then I guess it's ok since it is stipulated in the labor code that employees maybe oblige to render OT or work during holiday

Hi atty maginquire lang sana ako. nagkaroon kasi ako ng biglaang opportunity sa other company at kailangan ko mgstart na nextweek and i have to leave my current company with just a short notification 4days to be exact. alam ko naman na dapat 1month yung pgpapass ng resignation kaya alam kong mgiging awol ako. ngayon ang current employer ko tinatakot ako na mgfafile daw siya ng case pg hndi ako ngcomply na mgstay pa hangang end of the month kasi marami ako maiiwan na work load at wala pako kapalit. tanong ko lang my kaso po ba ako nun mkakapag file poba sila saken? in the first place pgkahire saken 3 years ago wala silang contract na binigay at pinapirma saken up to know. isa din sa mga nging factors ng bglaang pgalis ko eh i found out na since nging empleyado ako sa current company ko eh hindi pala nababayad mga benifits ko pero nkakaltas ako.. i have my payslip to prove it.. even mga tax namen ng mga co-employee ko. Empleyado ka nila at meron silang katunayan.

Pwede silang humingi ng danyos (damages) dahil sa bigla mong pag-alis.

(eto po yung scenario)

Na hired po ako as 1 month trainee sa isang company then after 10 days bigla po tumawag yung agency going to abroad. Then nagpapalam po ako sa HR Manager namin na di ako makakapasok for 3 days because of traning kaso bigla nila hinold "ayaw pa bigay" yung salary  ko even though di pa ako officially resign or AWOL.

Ano kaya pwede ko po gawin?

***not literally trainee po, hired na po ako but my contract po is 1 month lang, parang probi. po. if after 1 month di nila nagustuhan yung perfomance ko they have the rights to terminate me.

Actually po I'm now planning to file a resignation letter na. kasi po yung agency is ni-required na ako to undergo sa training class every Wed, Fri & Sat. which can affect my work so badly.

kaso po if mag-file ako ng resignation for sure po di ko po masusunod yung 30 days notice dahil dun sa training ko thrice a week, for sure magigigng AWOL po ako, pero kapag di naman po ako nag-resign aabesent po ako every Wed,Fri & Sat. na pwede din po mag-cause ng AWOL.

Ang concern ko na lang po is yung Last Salary ko, gusto ko lang po talaga makuha..in my case may right po ba ako kunin yun? kahit conflict na yun situation ko betweeen me and the company

You are entitled to receive the salary you worked for.

Meron lang po sana akong itatanong. 1 month na boyfriend ko sa work nya sa kfc at na regular na dn daw sya. umabsent sya nung friday dahil nagkaron sya ng migraine. ininform nya ung manager nya na absent sya for that day at reply ung manager na "okay". kinabukasan pag pasok nya ininoform sya na wla syang sched at naka Awol daw sya. hindi daw baka duty ung manager na pinapaalaman nya pero bkt d man lang ininform ng manager dun sa isang manager na nka duty at that time. pinapupunta sya sa agency nya para mag report. ano po ba ang pwedeng mangyari at ano po ang mga pananagutan ngaung nag paalam naman sya? we really need this job lalo na theres a baby otw.. thank u!

Actually po i tried to find any post related dito wala na pong answer yung iba.. and the fact lang po kasi na nagpaalam naman talaga siya the next day pag pasok niya AWOL na sya now this is the problem I want to know if there is anyone who can enlighten me? thank you!

Just want to ask, nag signed po kc aq ng 1 month contract as a trainee sa isang hospital, pero nklgay nmn po dun sa napormhan q, not yet considered as employee... D n po aq pumsok since 2 days.. Mlaking issue po b un? And mkikita po kya un sa mga aaplyan q png company n nag awol aq?
