Dear Atty.,

I am presently working in a private company for more than 2 years. my first contract term was 2 years, starting from september 2009 to december 2011. during those tenure, i never signed a contract contradicting what is indicated in the job offer indicating that the contract will be next to be signed after signing the job offer. because of too much confidence that the company would served the draft of the contract before the end of the term, i never demanded to the HR for a contract since i am receiving my monthly paycheck. And also my direct bosses told me that ill just wait for the contract to be served until the contract period ended. it was then i was too eager to read what is in the contract that made it too long to be drafted, i asked the HR for a copy of (this just happened just recently). they said, it was my bosses who had flaws on drafting the contract that made it prolonged to be served. in my own thinking they were pointing fingers who would be blamed in releasing the contract. My query is, if I filed a case to the company regarding to their negligence. Ano po mangyayari sa akin? my possibility po ba na e terminate nila ako? or my compensation po ba and ginawa nila? i am now on my 2nd contract. thank you po.

if they allowed you to keep working after the 2 year period, then you should be considered a regular employee, and you don't need a new contract for that.
