Hi AttyLLL,

Good day!

I just would like to ask once a certain case is already been filed in the RTC, normally how long it would to take them to issue subpoena and warrant of arrest to the accused person?

Because it is with the RTC, it will not be a subpoena but a warrant of arrest. Subpeona will be issued only if the accused had already posted bond. The Rules of Court provides that the Judge of the RTC should study the case within 10 days from the filing of the Information (the document accusing the person of a crime). Normally, the judge issues the warrant immediately after he finds probable cause for the issuance of the warrant.

Better prepare an amount for your bail then go to the clerk of court of the branch where the case was raffled and tell them that you would be filing bond so that they not issue a warrant. If you will surrender to the court immediately, that could work to your favor if the case is not settled and the case will proceed to trial.

How would I know the bailable amount? do the clerk of court knows how much?

The case folder with the clerk of court would readily show the amoun of bail recommended.
