Hello po. Need advice.

Nabuntis po ang ate ko 2011. Hindi sila kasal dahil kasal ang ate ko sa una.
Tapos po after ilang months nagabroad sya.
Samen nya iniwan ang bata. Tapos umuwi na sya. Tapos umalis ulit sya at sa tatay na nya iniwan.
Pero after ilang months nalaman nya na nambababae yung lalaki kaya pinakuha nya saken ang bata.

Ever since na samen na ang bata.
Mag 7yrs old na sya sa katapusan.
Ang tatay nya may pamilya nya. Ang ate ko may iba na din.

Ngayon kukuhain na daw ng tatay ang baya samen sa legal na paraan.
Alam ko mas may karapatan sya kumpara samen. Pero mas may karapatan ang ate ko. Kasi hindi sya dito samen nakatira.

Anong pwede nameng ilaban para hindi makuha ang bata?

According to the Family Code, the mother enjoys a presumption of parental custody over a child 7 years old and below. For now, the mother has the upper hand against the father, unless the father's lawyer will bring up other factors that may convince a court otherwise (like an unhealthy family abode where he is growing up, since the law prioritizes the welfare of the child above all).

You should hire a lawyer who specializes in family law so that he can help you in filing the necessary petitions in court should the father choose to file a custody case against the mother.
