Hello po. Gusto ko lang po malaman ang legal rights ko. Kumuha po ako ng cp worth 20k. Nag downpayment ako ng 6k para po marelease ang phone. The next month, nagkataon namang naghiwalay kami ng asawa ko at naiwan sa akin ang anak ko. Naiwan sa akin lahat ng gastusin kaya naisantabi ko po ang monthly ko sa Home Credit. Since then, wala pong tigil ang home credit sa pagtawag sa lahat ng reference ko during application at naiintindihan ko naman. Kaya lang talagang di ko pa kaya sa ngayon ang idagdag sa gastusin ang sinisingil sakin dahil aabot ng 18k to think na 20k lang phone at nakapag down ako ng 6k. Hanggang sa puntahan na ako dito sa bahay, sigaw sigawan ng collector at kaninang umaga, nagtext sila na magpapadala na daw ng sherif para kunin ang mga gamit dito sa bahay dahil sa di nabayarang monthly at may kaso na daw po akong qualified theft. Sa ngayon po, puro demand letter sa office nila at text pa lang ang natatanggap ko. Gusto ko pong malaman kung matuturing na qualified theft ang kaso ko kung may downpayment naman po ako at kung legal ba ang gagawin nilang pagpapadala ng sheriff para kumuha ng gamit ko. At kung di ko na po talaga kayang mabayaran ang utang ko, pwede ko na lang po bang isauli ang unit or may mas magandang paraan gaya ng paghintay na lang ng demand letter from the court at makipag settle sa terms na kakayanin ko?

Assuming your facts are what really transpired, there is no qualified theft here as per the RPC provisions.

Those are just the tactics of the collectors of Home Credit in order to have their debtors pay their balances. What they would file if they really go to court is a civil case for a collection of sum of money, and that is in the small claims court since your amount falls under their jurisdiction.

What you should do is to CALL HOME CREDIT and talk to them. Tell them your current financial situation AS HONESTLY AS YOU CAN so that they can possibly agree to a loan restructuring agreement with you. Have it in writing and pay it in an amount that is feasible with your current financial situation, if they so agree.

If you need further legal advice, secure a Certificate of Indigency at your Barangay Hall and go to the nearest PAO to seek free legal advice in their office.

Hi good day, patulong naman po ano po ang dapat kong gawin? november 2017 ako tapos nahulugan ko lang siya hanggang january 2018 nabuntis kasi ako ta maselan ang pagbubuntis ko. nawalan din ako ng trabaho almost 3 months. pwde ko bang bayaran sila kasi paunti- unit hanggang sa matapos ko kung magkano na lang ang balanse ko sakanila? ifoforward pa ba yun sa legal council? patulong po. salamat

CALL THE LENDING COMPANY AND TALK TO THEM REGARDING YOUR CURRENT SITUATION. Ask them to have your loan restructured in a way that will be feasible for your current financial status. Be honest when dealing with them, so that they will see the sincerity of your claim.

Whatever you will agree upon with them, have it put in writing and avail of a copy of such. Everyone must sign the document for proof of its veracity.

If you need further legal advice, try going to the PAO to get it for free. However, you must secure a certificate of indigency with your local barangay hall first.
