Hello po mga Boss,

Good day!

Mayroon po akong nabiling property sa PAG-IBIG, SPA (1st SPA - family relatives - May 2014 ) na mag-process ng lahat in-behalf sa akin at property agent (2nd SPA - Sept 2015).

Sa dahilan magulo ang transaction ng SPA (1st SPA - family relatives) namin . Nagdecide po kmi ng asawa ko na e-give-up ang property at ibinta sa iba. Kasi yon 1st SPA namin naigastos nya ang pangprocess ng transfer of title sa personal needs nya. Dahilanan ng buong pagtitiwala sa 1st SPA (family relative), around 1 year kami hinintay (until na approved ang PAG-IBIG loan ko) para sa transfer of title, pero walang transfer of title nagaganap at doon kmi naghinala sa mga anumalya na ginawa ng 1st SPA naman.

Kaya kina-usap namin ang property agent (2nd SPA) na gawin syang 2nd SPA (Sept 2015) para sya mg-process at mghanap ng buyer para marefund yon total expenses sa property. Kasi un 1st SPA di kayang bayaran ang pang transfer of title expense at maraming dahilan. At 2nd SPA na rin bahala sa paninigil ng utang ng 1st SPA para maka-iwas kami sa family conflicts.


Kaya yong 2nd SPA namin may nahanap na buyer, nag-sign at nag-agreed sa Deed of Assignment, Waiver and Transfer of Rights. Yong buyer nagbayad initial installment 40% ng total cost at 60% remaining balance  from Oct 31, 2016 to Dec 31, 2016. Naghintay kami ng 1 year ( Dec 2017) hindi parin kmi nababayaran ng buyer sa remaining balance. Until na discover namin na full-paid na pala ng buyer ang property sa PAG-IBIG. Kina-usap namin ang 2nd SPA bakit inuna ng buyer ang fully-payment sa PAG-IBIG habang di pa sila bayad sa amin. Sabi ng 2nd SPA para makaiwas sila sa interest sa kanilang pagbabayad. Ngayon, ilang months (Jan2018 - present) na kami nag-follow-up sa 2nd SPA and buyer lagi nalng sinasabi follow-up next month. Until narinig ko sa 2nd SPA na yong buyer nag-process na ng transfer of title. Mga Boss anu pweding gawin dito?

Mag Boss, pa advice naman kung anu pweding legal ways para magbayad yong buyer namin. Hangang ngayon di nag-cocoordinate ang buyer at 2nd SPA namin. Pwede ba naman kasohan ang 2nd SPA at buyer?

Bago matransfer nung buyer yung title sa pangalan nya, ipa-annotate mo na sa title yung claim nyo over the property. Unahan mo na.
