Good day po..magpapasalamat n po ako agad sa lahat..
Ung lupa po n kinatirikan ng bahay namin ay bnbnta n po ng may ari.. 33.50sqm out of 100sqm, pinasurvey at deretso subdevided plan po nangyari kaya nalaman namin exact size ng lupang sakop ng bahay..sinanglang tira po namin ung bahay para mabayaran ung lupa..xempre po with knowledge ng may ari ng lupa.. At nagkapirmahan n po ng deed of sale. That time po n nagbntahan nawawala po ung owner's duplicate copy ng title, pero nagcheck po aq sa RD at clean nmn po at no prob ung record ng title.. Eto mga tanong ko..

1. Mag 7months na po ung deed of sale indi nmin maipasok sa bir dahil d nia po inaasikaso ung tax declaration mailipat sa pangalan nia(nasa previous owner pa nakapangalan). Paano po kaya iyon?

2. Nagpagawa aq ng AFFIDAVIT OF ADVERSE CLAIM 7months ago din kaso d q mapasok sa RD kasi usapan is kapg naayos ung tax dec uulitin ung deed of sale at affdavit of adverse claim,para d po kame magpenalty sa bir. Pwd p po ba ipasok ung Afidavit of adverse claim kahit 7 months ago pa?

3. Ano po pwd nmin gawin kasi naun po nagsasabi ung may ari ng lupa n indi daw maasikaso ung titulo kasi di p bayad ung iba.. Pero kame fullypaid na..

1. Pwede nyo dapat maipasok yan sa BIR kahit ang tax declaration ay nakapangalan pa sa kanya. Yung tax dec ay para sa bayad sa amelyar. At ang amelyar ay binabayaran sa local government, hindi sa BIR. Ang mahalaga sa BIR ay mabayaran ang capital gains tax saka documentary stamp tax, kaya once mabayaran mo na mga yun, i-submit mo na yan sa kanila (BIR) para ma-issuhan na ng CAR (certificate authorizing registration). https://www.alburovillanueva.com/land-titles-real-property-registration

3. Kahit naman hindi pa bayad yung iba, pwede mo nang asikasuhin yung portion ng lupa na nagpe-pertain sayo. Ikaw na mismo ang mag-asikso, baka may mangyari pa.
