Hello. Hihingi lang po ng advise regarding the frustrated murder case. Yung brother ko, siya ang tinuro ng foreman niya na bumaril daw sakanya. Nakapag plead na po ng not guilty ang brother ko, then may schedule na po ng monthly hearing. Next month is the start of pre- trial. Last week, ngsign po ng affidavit of desistance yung complainant, pero parang mahigpit daw ang judge, balewala ang desistance. Ano po ang possibilities kahit may desistance na? Thank you

an affidavit by itself will not lead to dismissal of the case. the complainant has to appear in court and affirm the affidavit before the judge

Yung complainant po kasi wala ng plano mgappear sa hearing that's why ngsign nalang ng desistance. Yung case po naka file sa Mindanao, dun ngyari yung incident, both complainant & accused are from Luzon. Anong mangyayari po kung ayaw na mgappear ng complainant?

Mas ok po ba na hindi nalang umattend ang complainant kung nag kasundo na sila ng suspek??
Kesa mag file ng affidavit of decistance???

if i were the accused, i'd prefer the filing of the affidavit of desistance so the case will be over

Gaano po ka tagal ma process ang desistance?? Need pa po ba talaga dumaan sa piskal? Bago submit sa judge??

yes, it should be approved by the prosecutor and by the judge. it can be done in 1 hearing

Hello Atty. Just a follow-up question. Nag pre-trial na po last week, di na sumipot ang complainant since ngfile ng desistance. As per judge daw mag-iisue ng warrant of arrest sa complainant, di namin alam kung asan na complainant kasi wala na sa dating address niya. How about on our side, is there a chance a ma-early dismiss or tatapusin ang 9months hearing schedule? Thank you.

Hindi naman po. Yung atty namin ang nag-file, pinirmahan lang nung complainant & pinanotaryo tapos binigay na samin. Dina siya ng-attend sa pre-trial.
