Scenario,

may tao po kase kame na i end contract na dahil hindi sya fitted sa position na kinalalagyan nya. nakausap na po sya verbally nung nov. 28, 2017 and sinabihan na po sya verbally na hanggang Dec. 29, 2017 nalang sya at sinabihan din na to follow nalang yung end contract na papel na pipirmhan nya. okay naman po sya nung nkausap at pumayag namn. ngayon valid po ba yung reason nya na magpapa dole sya dahil nung kinausap sya hindi agad sya pinapirma ng end contract?

probationary pa ba sya? regular na? Anong dates sa contract nya? when start when finish?

If the employee is under probationary or "fixed" term, wag kang matakot na mag DOLE siya. But you need to factor in the start and end date of his employment. Dyan ka ma "technical".

bale po kase sa construction kame based lang po sa project kaya ang contract namen pa extend extend lang. bale po nagpapirma po ulit kame ng contrata from Nov. 11 to December 31, 2017 sso binigyan po sya ng verbal notice na 30 days na i end na yung contract nya ng December 29

so its a project contract. mag reklamo siya sa dole na hindi siya na inform sa end of contract niya?

anyway, may point siya, pero ano hahabulin niya? nag file na ba siya o nag babanta pa lang?

magrereklamo daw sya na ininform sya verbally na 30 days nalang sya dapat daw nung kinausap nya kasabay n yung end contract paper nya.

yes but even if thats true and magfile sya and manalo sya. He will only will yung 2 days.

Which is another thing, ang mean spirited naman nung taong nag decision na not just to let his contract expire but instead to terminate him with only 2 days remaining in his contract.

I also came from a construction industry so I know what you are stating. It will help you in your case that he remembered being verbally notified 30 days before regarding his end of contract.

Anyway, next time, find ways that when you talk to workers you should already have a documents for them to sign.
