hi just want to ask po, my daughter born Feb 2012 nka lagay po fathers name s BC nya pero wlng sign ng father, her father is saudia, we are just married culture marriage lng po Muslim like blessings lng since we can't apply marriage cert s Saudi, but after mg 1yr and 5mos anak ko wla n kmi ng father nya ako na ang gumastos s anak ko since 2013, up until now, pwdy ko po ba palitan yung last name ng anak ko?? we don't have any communication s father, and wla na kami habol since Saudi ang father nya, ano po kya requirements para mapalitan ko last name nya sa BC?!? at s passport ng anak ko? nadala ko po kasi Anak ko s Saudi gamit ung BC n nka register un din ginamit ko para kumuha ng passport, since nurse ako dati s Saudi madali ko nakuha anak ko every 6mos renew ng visa nya pero s third time n rerenew ko visa nya dito s pin as humihingi n cla ng clearance s father nya, kya d na sya nkatuloy, then gs2 ko na palitan last name nya para in future if mg travel kami hndi n need ng consent ng father since wla n kmi communication. thanks po

Check with a sharia counselor kung pwede yang balak mo. as far as the law is concern, hindi valid yan reasoning mo para palabasin na walang ama ang bata.

eh anong katunayan nyo na kasal kayo sa Saudi? yung nagissue ng document na yun ang pagtanungan mo sa issue mo. pero as far as Philippine law is concerned, hindi mo pwedeng alisin yung tatay ng anak mo sa BC nya.

Kaso ang issue dyan ay yung filiation between sa anak mo at tatay nya. kung established na ito (liked signed sa BC) eh hindi ito nirerevert unless papatunayan na iba talaga ang totoong tatay ng bata.

in my opinion, you would have to file a petition in the RTC for the correction of the record based on the fact that the father did not sign the birth certificate

Pano ko po papalitan ang surname ng anak ko . sakin po kasi nakasurname yong anak ko gusto ko na san ipaapelyido sa papa nya .

go to the Local Civil Registrar and inquire about filing an Affidavit of Acknowledgement of Paternity so that it can be annotated on the birth certificate, or if you get married, ask about legitimization by submitting a copy of your marriage certificate

paano ko po mapapapalitan surname ko? Surname po kasi ng mama ko nsa PSA birth certificate ko pero kasal po sila. May nka attached din po na acknowledgement. Pero di po mapalitan kasi walang jr. na nakalagay sa name ng papa ko. Sa lahat po ng papers pti marriage contract, may jr. po. ano po ba ang dapat ko gawin.

Meron din po akong copy ng birth certificate na surname ng papa ko ang gamit. galing po sa Local Civil Registrar Office. mai page and book number din po. Pero sa PSA mismo, wala pong copy. Hindi po nila mahanap yung affidavit na pinirmahan ng father ko noon. Paano po ang dapat kong gawin?

ask the civil registrar about the requirements for legitimization. this should only require the filing an affidavit from your parents admitting your father as your father and submission of a copy of the marriage contract to show they are married

hindi daw po mai pa legitimize kasi yoong nka register na birth certificate ko, wala pong jr. ung name ng father ko. lahat po ng docs mai jr. paano ko po maipapaayos yoon?

ask the civil registrar if this can be considered a clerical error which can be corrected administratively. if they refuse, then you will have to hire a lawyer and file a petition in court to correct it

after you and your current partner have married, file a petition for adoption so the child can carry your future husband's last name

But is it possible if I can change his last name into mine while waiting for the marriage to happened?

if you process the adoption first, the child will have no legal connection to your future husband. the adoption will have effect only as to you

yes, in theory. but your talking doubling your legal costs and effort.

Do we still need to get permission sa biological father if i want to adopt my wife's daughter?  My wife and I already have our own daughter pero syempre habang lumalaki e may posibility na makutya siya dahil iba apilyido niya sa amin.

Not really in good terms with the biological father. Currently she's still minor (12 y/o). however in th future does my step daughter still need to get permission if nasa legal age na siya?
