Motorcycle Loan from Bank of Makati

Hi Atty.,

Ask ko lang po sana kung legal po ba na kunin na nila motorcycle ko. They sent me a letter yesterday sa bhay namin (received by my dad, nasa labas kase ako) and they told them na for repo na daw ung motor sa monday. When i checked the letter it is just a reminder of my payment without mentioning anything about reposition. The thing is 5 and a half months palang yung nababayaran ko (pero not exactly na ko bnyaran ung ilang bwan na sunod sunod, alternate ako nkpg bayad simula last year). I tried makiusap sa mga contacts sa letter from bank na magbabayad ako for payment 3 months pero di na daw pde kase d daw ako naghulog last month (october). Question is, pede na ba nla tlga kunin motor even na may 5 and a half month ako nkpg hulog at maghuhulog ng for 3 months this end of the month? I hope masagot nyo sana kaagad because kukunin na nila motor this coming Monday.

check your contract. usually meron clause yan na pwede nila repo yung sasakyan if mag fail ka mag hulog in X consecutive months or X non consecutive months. Tingin ko dun sa later nagfafall yung case mo.
