Can I have the contract nullified if the apartment is in violation of the sanitary code?

We were renting a place. It did not bother us then when the canal at the back of our apartment was giving off bad odor. but when my son and wife got sick we decided to leave the apartment. The owner is demanding payment but for us what we spent for hospitalization was so much more than the rent. so we are planning to have the contract nullified due to its violation of the sanitary code.

Yes you can nullify the contract. The sanitary code is deemed incorporated in your contract, hence, breach from such code is a valid ground for the nullification of contract.
