Meron po kasi akong 3 year Bond worth 500K. May 3 months training/boot camp daw kami. Pero Sa 1st 3months namin, wala naman kahit anong training at sabak agad sa trabaho at allowance lang narereceive ko sa loob ng 3months kasi "boot camp" or training palang dapat pero wala naman training na nangyari at sabak agad sa projects. So 3 months akong walang salary, kasi Allowance for training lang naman yun at hindi salary for work. Almost 2 years na ako pero wala pa din kahit anong training, walang nangyayari. Kaya balak ko ng umalis at hindi tapusin ang bond ko.

Question ko.
Legal pa din po ba yung bond? May laban pa po ba sila pag nagresign ako ng formal? May karapatan pa po ba silang pagbayadin ako kahit na wala akong nareceive na kahit anong trainings?

Sana po may makatulong. TIA!

May laban ka kasi walang basehan ang paghingi nila ng bond pero aabot sa husgado yan.

Kung may karapatan sila o wala at kung ito ay aabot sa husgado, ang korte lang ang pwedeng magsabi kung may karapatan sila o wala. Syempre sa simula, kung sisingilin ka nila e ipipilit nila ang karapatan nila pero kung ito ay kokontrahin mo sa korte e ang korte na ang bahalang magdesisyon.

Greetings!
An employment bond of three (3) years shall be imposed upon signing of this contract. Should you fail to render three (3) years of service, you are required to pay the company in the amount equivalent to two (2) months of your current basic salary.

yan po yung nakalagay sa contract ko, 8 months na po ako sa company ngayon, if ever pong magresign ako at hindi ko bayaran, can I be sued? the company has many cases sa bir and yung practice nila sa accounting ay hindi tama, can I use that reason if ever magdemand man sila?

no that doesn't have anything to do with it. unless you claim that the company isasking you to do something illegal. accounting ba position mo?

yes sa accounting po. pag nagpa-file po ako gn vat returns at masyadong mataas ang babayaran pipabawasan po nila. wala naman po akong choice kundi sundin sila pero personally speaking hindi ko po gusto yung pinapagawa nila dahil alam ko pong mali.. one of the reasons kung bakit gusto ko na pong magresign

ang problema if you use that as a defense you have to prove it. if tutuo yan baka matakot yung employer and hindi ka na nya idemanda but if idemanda ka nya i belive you will lose

Happy new year to everyone!

I have a bond with my Company and matatapos po sya by end of this year. Ang agreement po is to stay with the company ng 2 taon, at kung hindi, you have to pay the total amount na nagastos ng company for the training at dagdag 20% na admin fee. In my case, ang amount po ay around 58K.

Ngayon po, meron pong better career opportunity na dumating at gusto ko po syang i-grab. Ano-ano po ba ang pwd kong gawin kasi sa ngayon po wala akong pambayad. Gusto ko rin pong malaman kung ano ang pwedeng gawin ng aking employer pag ako'y nag-resign at walang pambayad ng bond. Kung magreresign po ba ako, pwede nilang tanggihan ito? Maraming salamat po.

Pwede kang idemanda ng 'collection of some of money' para singilin ang bond mo by way of 'damages'. Hindi ito criminal case at hindi ka makukulong.

Walang taong pwedeng tumanggi kung magre-resign ang isang empleyado. Maski presidente ng Pilipinas, hindi pwedeng pigilan ang tao na gustong mag-resign.

Hello po. Regarding employment bonds also, if you have the same contracts as your colleagues with a bond stipulated, but some of them already resigned although they did not finish the years required in the contract. When it was your turn to resign and the company refused because you haven't finished the tenure, can you argue the case in DOLE or in court where others were allowed to resign despite not honoring the contract?

hindi. parang utang or obligation sa companya yan, if hindi nila hinabol ang ilan na may pagkakautang sa kanila, hindi ibang sabihin lahat na may utang abswelto na.

Mayroon pong nakapagsabi sa akin na magbigay ng promissory note sa kumpanya kung sa ngayon na aalis ako ay wala pa akong pambayad ng bond. Ang tanong ko po, pwede po bang tanggihan ng kumpanya ang aking promissory note at pilitin akong magbayad kahit wala po akong pambayad? Ano-ano rin po ang mahahalagang detalye na dapat ay maisulat ko sa promissory note?

Kung kumpiyansa kang walang basehan ang bond na hinihingi nila e hayaan mo silang idemanda ka.

Magresign ka at humingi ka ng Certificate of Employment mo. Sigurado yan hindi ibibigay dahil sa hinihingi nilang bond. Ang gawin mo ay magreklamo ka sa DOLE. Dun kayo maghaharap.

Mapipilit ka lang nila na ibigay ang bond na yan sa isang paraan lang. Yun ay ang pagsampa ng Civil Case. Kung wala yun, wala silang karapatang pigilan ka magresign o hindi ibigay ang Cert mo.

Wag ka magbibigay ng promissory note. Inaamin mo lang na my utang ka sa kanila kung magbibigay ka nun.

Kung magbibigay ka ng promissory note, siguradong hindi nila yun tatanggihan dahil gagamitin nila yun ebidensya na meron kang obligasyon na kailangan bayaran sa kanila. Mas lalakas ang loob nilang mag-file ng civil case laban sayo, kasi ikaw mismo ang nagbigay sa kanila ng bala. Pwede ka nila itali sa pangako mo, parang kontrata.
