Hi Attorney,
Give me some advise naman po, this is my situation right now. currently i was employed in IT company in taguig. ANg problem ko po is yung bond na nakalagay sa contract ko last 2015 nung nagsign ako. 2.5 years yung bond ko to this company. Pero balak ko na po magresign this month, is this okay? or not?
Kasi yung training nila samen is hindi naman galing sa labas yung nagtrain samen, which is yung mga empleyado lang din sa company. kaya parang hindi naman ata tama na may bond kami.

is it a training bond? Not all bonds are related to training kasi. Damages are also not always related to training.

Is the amount too big in relation to your whole contract?

Hi Sir lukekyle,
thank you po sa pagsagot.
Yes po training bond po ito, worth 275K po sya.
1.5 yrs na ako dito sa company pero yung bond namen is 2.5 years po.
tapos balak ko na po magresign, worry ko lang po baka harangin nila yung resignation ko dahil sa bond.
Ano po ba magandang gawin?

also training can be internal, thru experience etc. It doesn't have to be from outsiders/consultants.

hindi mo pwedeng sabihin na hindi gumastos. Yung mga tao na nagtrain meron din silang sweldo. Yung facilities na ginamit, yung office nyo may rent, electricity etc. Ikaw habang nagtrain ka meron bang sweldo? Gastos din nila yun.

That being said parang sobrang laki naman yung 275k para dyan. In my opinion pwede silang mag charge ng damages for the training but lower than 275k siguro. That will be up to the court to decide.

Paano po Sir kung may pinayagan silang mag resign kahit di pa tapos ang bond? Salamat po.

Nakahanap na po kasi ako ng lilipatang trabaho.
Hindi na kasi align sa ni-train samin yung mga trabahong inaassign nila sakin ngayon. Mas okay yung opportunity na inaalok sakin. Ang problema po, kelangan ko na mag start asap at hindi ako makakapag comply sa 30 days notice ng resignation.

Pwede po makahingi ng advice? Nanghihinayang po kasi ako sa bagong opportunity.

malaking gusot ang possibleng kaharapin mo. My personal opinion hanggang wala pang new commitments made, tapusin mo na yung contract. You can try to negotiate an early exit but sa taas ng "bond" na naksulat sa contract medyo mahirap.

Hi Sir,

I need your advice. I am with Recruitment Team and I am under a commitment bond for 1 year (mostly it's our developers and other employees who are with technical team who's under this bond) but I am already planning to leave the company as early as now. I asked HR why we (recruitment) have a commitment bond, and they mentioned that we shouldn't have it in the first place. They said it should've been stipulated as "liquidated damages" instead of "commitment bond" but still for 100K. Turns out they haven't provided us the revised contract when we signed up. Ma te-technical daw sila dahil nito.

So here are my questions po:

1. Is it an option for me to NOT sign my regularization on May or would they use the commitment bond against me (so parang obliged to sign my regularization)?

2. If that's the case, can I be the one who will take my contract against them since I shouldn't have a commitment bond in the first place?

I would appreciate your response sir. Thanks

1. did you sign anything re this "commitment" bond? If wala and naka fixed date contract ka (meaning may start and finish date) you can opt not to sign regularization papers. If hindi ka naka fixed date contract and wala kang ni sign re commitment bond, you will have to resign and render 30 days.

2. if you signed one then your bound by it, if you didnt sign one then one wont affect you. Whether you should or shouldnt have one is a matter of company policy. It isnt illegal per se so you cant file a complaint against them

so why are they concerned if ma technical sila dahil commitment bond ang naka stipulate sa contract ko? do I have other options po?

dahil engot sila? why would i know kung bakit sila takot? Liquidated damages are charges na pinagkasunduan if hindi mafullfill ang isang contract. A bond is an agreement in itself.

ang pinagbabawal ay yung employee cash bond para sa mga industry na hindi normally ni require nito. example hihingan ka ng P10,000.00 ng employer para pag may penalty laban sayo dun nila ibabawas. dba almost tapos na contract mo? why not just finish it
