Mali yang pagkakaintindi ng superior mo. Of course 6mos yung proby period mo pero pwede kang magresign at walang sinuman na makakapigil sayo kung gusto mong mag-resign. Kung ito ay ipipilit ng supervisor mo, ito ay 'INvoluntary Servitude' na. Ang Philippine Constitution mismo ang nagbabawal nito.

Ang 'Involuntary Servitude' ay nagsasabi na ang isang tao ay hindi pwedeng magtrabaho para sa isang tao/kumpanya kung ito ay ayaw niya o labag sa kalooban niya. Bawal pilitin ng isang kumpanya na magtrabaho sa kanya ang mga tao niya at pagbawalang magresign.

WALA, unless my ginawa kang mali before ka nagresign.

NOTE: It is technically 'breach of contract' that happens when an employee signed a 6-mo proby contract. However, this is NOT the same as 'breach of contract' as an actionable wrong. If an employee resigns, he/she is only exercising his right.

My karapatan namang magdemanda laban sayo ang kumpanya mo pero and tanong e my Cause of Action ba sila? Sa tingin ko e wla.

Ask ko lang po awol po kasi ako and hinold po yung sahod ko dahil dun. May chance pa po bang mawithdraw yun and naka 5 months din po ako. May matatanggap pa po kaya akong backpay and 13th month pay?

Depende. Kung 3 or more than 3 years na ang nakaraan, baka hindi mo na makuha yan. Pero kung pasok pa ay dapat ibigay sayo yang backpay mo kasama 13th mo pay mo pagkatapos mo iprocess ang clearance mo.

Ah ganun po ba. Bale kelangan padin po talagang magclearance kung gusto ko talaga makakuha ng 13th month. Eh yung sa unpaid salary po pano naman po yun? Nasa atm ko na po kasi nakahold lang po. Ayon po sa friend ko na nagtrabaho sa sm, pag may awol daw po sakanila hinohold din daw po yung sahod pero after 3 months daw po nakukuha na din. Sa lahat po ba ng kumpanya yun or depende din po?

Tahimik ang batas pagdating jan pero ang process, hinohold ng employer ang 'backpay' hanggat hindi natatapos ang clearance.

Hi to all bka po pwd niu ako matulungan may problem po ako about awol and resign ang problem ko po nagresign na po ako and then nagkausap po kame ng hr admin namen na magresign po ako and nkausap ko manager namen about sa resignation ko after po nun nagkasakit po ako d ako nkapasok and then nagmessage po ako sa email namen sa work ang message kung d na po ako papasok and then d na po sila nagreply so d po ako mkapgdecide if tanggal na ako o hindi but nagadvice ako na that day may trangkaso ako ang tanung ko po makakasuhan po ba ako ng breech of contract or  sadyang ayaw na po nla ako pabalikin sa trabaho salamat po sa tulong sana po matulungan nyo po ako

Paano namin masasagot yan kung ikaw mismo ay di mo alam kung AWOL ka o resigned.

ALAmin mo muna ang status mo pra masagot namin tanong mo.

sorry to barge in

pa help guys,
im working as a customer service rep here in cavite(bpo).i signed a contract that is per hour in nature, ang bayad literal na per hour kasi they are not paying for meetings bladder breaks and short breaks,talagang auto in lang ang bayad,ang mahirap pa they will force you to extend if hnd ka naka 8hrs,i escallted this to hr and the management pero napaginitan lang ako,last december they review all of my call at naghanap ng butas,they caught me dropping a call dahil ungas ang customer ko,i submitted an nte na wala ako pinirmahan na policy na bawal magdrop call which is totoo naman na wala at marami gumagawa nun including sups.nakalusot ako but next day sinuspend ako dahil sa q.a. score
65 out of 100.at that day madami kami bagsak some of us got 0 pero ako lang sinuspinde,naserve sakin ang suspension notice same day sarado pa ang hr.so went to dole and file a complaint,when the company heard it biglang nagpatawag ng hearing,i attended and stick to my statement na walang guidelines ang company since we didnt sign anything.nareinstate ako binayaran nila yung days na wala ako pero yung accured leave hindi,tapos ibinalik ako sa team ko na ang may hawak yung manager na inireklamo ko.after a month nagfile ako ng leave in accordance to our policy na pwd ka gumamit ng 10days leave all the time akala ko nakaleave ako and bayad,pagdating ng sweldo nagulat ako hinold daw nung manager kasi hindi na daw pwd yung policy na yun.nagreklamo na ko sa nlrc waiting for hearing nalang.


my question is:

1.illegal suspension tama ba?
2.reinstated sa same team?
3.retaliation article 118.
4.may habol ba kami sa work hours at ot?
