Need advise po.
I was involved in a road accident inside our subdivision. Case is going for 13 years now. Nakasagasa po kasi ako ng drunk pedestrian. it happened on a rainy night, on a not well lighted part of the road. as per their testimony, the guy came from a bar at the other side of the street, nkatawid na daw sya and he's about to reach into he's car's door (which is illegally park on the side parallel to my direction, that makes the road narrower for motorist), pero hinabol sya ng waiter dahil kulang ung binayad nya, and that's when tumawid nmn sya agad pbalik (or na outbalanced sya sa pagtawag sa knya at dahil sa lasing sya), dun ko po sya nabangga. may laban po ba ako sa case? knowing that i have not violated any traffic laws before and during the incident. i was not over speeding. my car is well maintained. my windshield is not tinted. my car is registered and i have a license. also can we make a point about the guy about to make a traffic violation as he was about to go home drunk (Driving Under Influence of Alcohol), and that clearly he neglects the safety of others by his actions, and that he's an accident waiting to happen it just happened na natyempo sakn ung pagkakataon. can i make a case that the incident is unavoidable on my behalf due to the circumstances stated above, that anyone on my shoes cannot avoid the same.
Also, what does "QUALIFIED" means on my case, as I cannot see any case with the same.
Please help. need your advise.
