sobrang salamat po sa advice...

Nitong pay period po January 13, 2012...kinaltasan po ako ng ofis nmen sa sweldo without my consent. Sabi po nila kinaltasan po nila ako kasi inacknowledge ko daw na kaltasan ako. Pero wla po akong pinirmahan na khit ano na pumpayag akong gawin nila yon. O khit po verbal hindi din ako nag agree sa knila. Ang reason po kasi nila dahil nga daw po me nakapagbook ako ng training accidentally. Kaya dapat lang daw na bawasan na nila ako sa sweldo at hindi na rin daw nila ibibigay yung backpay ko. Kasi po iniinsist nila yun ang suggestion ng lawyer nila. Tama po ba yun?...Pano po ba kumuha ng Pao lawyer? How about po sa private lawyer how much will it cost for labor cases? by the way po, kelangan ko pa po bang magsend ng letter regarding dun sa pagbigay nila sken ng 50% lang ng salary ko? Makukuha ko pa po ba yung backpay plus ung 50% na ibinawas nila sken khit ganun po ung situation? Thanks po.

Hi Atty. Buti nalang po at merong ganitong website for employees like us. Now,I am employed sa isang BPO company and we have a training bond na 250k for 2 yrs. Bale nakaka 1yr and 2mos napo ako.
Before, inilagay nila ako sa night shift for almost 4 mos. kaso humina ang immune system ko.lagi akong leave dahil sa hilo. Sabi ng overall manager, need ko lang po ng medical certificate para hindi na nila ako ilagay sa night shift. Kaso, after 3 months sa morning shift, inilagay na naman nila ako sa night shift. Kaya nag leave na naman ako sa hilo at over fatigue (as per doctor).If magreresign ba ako now, hahabulin nila ako for 250k? sabi pa nila, hindi daw pro-rata yun, at dapat daw cash kong maibibigay. Eh kung ganitong pilit nila akong inilalagay sa panggabi na hindi ko naman kaya, eh napag iisipan ko na lang po ang mgresign. Paki-advise naman po ako. Nagwoworry kasi ang parents ko sa medical condition ko po. Thanks in advance.

i can't say what your employer will do, but if they do file a suit to collect, then you can try to defend your self with an argument that the bond is not legal.

Atty, thanks po sa reply nyo.
Hindi po kasi ako familiar sa mga ganitong situations/laws.
Ask ko lang po if hindi legal ang bond, bakit sila ina-allow na magpatupad ng ganon? Bale, wala pong naka-indicate about sa training/employment bond sa Labor Code natin.
Pero, pwede ko ba pong idefend din na, yung inaplayan namin ay engineering position (na napakaganda ng description) pero ang gagawin pala namin ay maghahandle din ng calls? Di ba po, isang panloloko din iyon?

because there has been no case decided by the Supreme Court on this bond issue, hence it cannot be presumed to be unlawful. note, i did not definitively say that it is illegal.

ultimately, it is a case to case basis.

Good day Atty.,

Question regarding my 100k training bond with a BPO in Makati. I signed this bond because otherwise I would not get the job, but before starting I requested that my start day be moved for personal reasons. The HR/Training Manager refused. I managed to attend training for two days before the aforementioned personal reasons snowballed and prevented me from resuming my training. Now, six months after, I received a call asking for post-dated cheques to settle for the amount of 97k. What would be the best course of action to take? I don't believe that two days of training merits 97k.

Hi Atty,

Question lang po, may pinirmahan po kasi akong contract with bond of 200k na babayaran if nagresign ako within one year or kapag nag backout ako sa employement. BTW, walang nakalagay na reason kung bakit ako naka bond (e.g trainings etc. etc wala). And to think, yung start date ko is one month to go pa, then, naka bond na ko nung time na nagsign na ako ng contract.

Hi Sir,

Please advice naman po.

Jobless po ako nung nag sign po ako ng employment contract with bond last Feb 1, 2012 sa isang company outsourcing firm, nag hire sila ng staff then idedeploy nila sa client.

Yung contract na pinirmahan ko ay wala pang start date as in blangko yung filed ng start date sa contract, kasi daw hahanapan pa nila ako ng client na dedeployan.

Hangang ngayun di parin ako nakakapag start kasi daw hinihintay pa nila yung response ng client for my deployment. Almost a month na po ay hindi parin ako nakakapag start ng trabaho.

Ang problem ko ay wala ako ibang source of income at I have 1 child so I need to get a job as soon as posible.

Pwede po ba akong mag resign kahit naka-pag sign na ako ng employment contract since di pa nman ako nakapag start?

Ngayun po nag try ulet ako mag apply sa ibang company na pwede ako makapag start agad.




I really need your advice.

I need some advise regarding the employment bond. I'm working with prestigious bank in the world, they have a employment bond for 1 year that I signed. But during my stay with the company my health condition get worst and was diagnose Stage 2 Hypertension. My doctor advise me to change my lifestyle and I'm no longer allowed to work at night. I filed my resignation a week after I was diagnose, by they are not accepting my claim. And they are having 2nd taught on the claim of cardiologist, even though that laboratory exam has been forwarded to them. They are saying it is not life treating. What can I do to resign for this company? Should I still continue to work with this company?

Seek lang po ako ng help, regarding sa contract bond.
IT support po ako dito sa Makati, Our Company sent me to Singapore for IT Training. Yung ginastos lang talaga ng Company namin is yung Airplane Ticket, Accomodation and Food pero yung Training is FREE talaga since Business Partner kami nung Company na yun and my Copy ako sa email nung nasabing Training.
Pinapirmahan ako ng Contract 100K if ever mag resign ako.

Ang tanong ko po if ever mag resign ako at habulin ako ng company at lalabanan ko sila sa Court meron po ba'ng PAG-ASA manalo ako since yung training is FREE?

hi atty, ask ko lang din po. kasi last november pinatraining po ako ng company na pinapasukan ko ngayon.. pero wala silang pinapirmang contract to bond me para dun sa training. now this, april 15 nagfile po ako ng resignation effective may 15 pa naman. ang problem po is hinahabol nila sa akin yung gastos dun sa training or dapat magstay daw po ako ng 18 months pa para macover yung bond. although wala naman silang pinapirma, ang basis lang po nila is yung email conversation ko dun sa isang HR staff na nagsasabi na wala pa akong balak magresign. pero may mga major issues po kasing nangyari sa opis kay nagdecide akong umalis.. tama po ba ang sabi ng HR na liable pa rin ako to pay or magstay kahit wala akong pinirmahang contract ng bond.

Ask ko lang po sa situation ko right now, working in almost 3 months pa lang and Me and our Client is agreed na i-end ko na agad yung employment ko sa kanila due to performance issue. Pumayag yung Client since for the last 3 weeks pa pala nila na-inform yung Provider ko regarding sa issues about my performance. But yung provider ko is wala naman ginawang hakbang like na i-inform man lang ako about this matter. Ang nangyari pa nga is nag mumukha na pala akong tanga sa ofis na pinagppyestahan na pala. So I decided with the client na wala naman na patutunguhan yung stay ko sa kanila kasi base na rin sa sinabi nila na feedback nila sa provider ko is naghihintay na lang ito ng malinaw na termination notice. But the provider does not do anything to contact me to inform about it until na ma-received nila yung last na time sheet ko. Now, pinipilit pa rin ng provider na pumasok pa rin daw ako dahil wait ako ng client but on the other hand is agree na yung client na mag end na ako. Pinipilit ng Provider na bayaran ko raw yung revenue na nawala dahil sa hindi ko tinapos yung contract ko.
My Question is, tama po bang bayaran ko sila dahil sa kagustuhan nilang pumasok pa rin ako na halos isuka naman na ako ng client kya nga nag agree na rin sila na mag end na nga ako sa kanila.
May contract bond din ako tulad ng iba na 1 year or equivalent to 100k, pero wala naman silang ginawang investment sa career ko and as in dineploy lang nila ako sa client nila.
Ang sa’kin lang is hindi ko habol ang employment ko sa knila dahil ok lang sa’kin na mabakante ako now and ayaw ko lang na hahabulin nila na bayaran yung contract ko na mas mahal pa kesa sa kinita ko in 2 ½ months kong work sa kanila. Hindi ko rin naman ginusto na magkaganun ang performance ko and nagkataon lang na masyado palang mataas yung standard and expectation nung client.
Ang worried ko lang now is baka idemanda nila me and wala na nga akong job is pagbabayarin pa rin nila me and saan naman ako kukuha ng pambabayad sa kanila. Kaya po sana somebody can help me here for any advise po.

i would say they don't have an action against you based on the bond, but they can seek damages based on abandonment. your employer is not the client.

Nakita ko po tong site nyo while searching sa katanungan ko regading employment bond.. sana na po mabigyan nyo ako ng advise.

Ganito po kc ang situation ko ngaun. gusto ko na umalis sa kumpanya na pinagtatrabahuhan ko kc hnd maganda ang pamamalakad nila. ang problema po eh pumirma ako ng training bond na two years or kailangan ko mag bayad 150,000 kung hnd ko matapos ang two years at kailangan ko na umalis.

pro bago po kc ako nag start sa kanila.. hnd po nila sinabi sa akin na may bond.. during HR interview at hiring manager's interview. saka ko na lng po na laman nung first day ko na at may inabot na lng ang hr na kailangang pirmahan na training agreement. wala po ako nagawa kundi pirmahan un kc nakapag resign na ako sa dati ko kumpanya at hnd ko ma aatim na ma bakante ng trabaho kc po ako po ang bumubuhay sa pamilya ko. hnd ko po alam kung may way ba para ma void ang bond sa argumento na nsaad ko sa taas. at isa pa po. hindi kumpleto ang training na naibigay sa akin kc bago pa lng ako pumasok eh nag umpisa na sila at dalawang lingo na ang nakakalipas..

Sana po ay matulungan nyo ako. maraming salamat po in advance.

nagtrabaho po ako sa PC REPUBLIC ng 3 months nagresign po ako dahil sa d makatarungan na pagkakaltas at hindi pagpapasahud ng tama delayed minsan installment pa ( cash advance )ang problema po kakasuhan daw po ako pag d ko nabayaran ang 3 months and half contract bond na 50k sa toto0 lang po wala akong alam sa contract bond meron po pala nun kahit sa mga katulad kung pangkaraniwan lang... first time ko lng makapagtrabaho sa ganitong company kea bobo ako..factory worker ako dati ng try lang po akong mag cashier sa computer retails Pc Republic.
