Ito ay ang pagsi-separate ng property after ng kasal. Ang rule kasi kapag ikinasal kayo and you did not execute a pre-nuptial agreement, you will be governed by community property regime. Ibig sabihin, "ang iyo akin, ang akin iyo". At hindi iyon mababago habang kasal pa kayo. Hindi yan pwedeng maging subject ng agreement lang. Pero yang ipa-separate sa korte thru a petition. Mag-aagree kayo kung paano ang hatian. Pero kung di kayo mag-aagre, pwede na ang korte ang magdedecide sa pagseseparate. Ang mga grounds ay ito:
“(1) That the spouse of the petitioner has been sentenced to a penalty which carries with it civil interdiction;
“(2) That the spouse of the petitioner has been judicially declared an absentee;
“(3) That loss of parental authority of the spouse of petitioner has been decreed by the court;
“(4) That the spouse of the petitioner has abandoned the latter or failed to comply with his or her obligations to the family as provided for in Article 101;
“(5) That the spouse granted the power of administration in the marriage settlements has abused that power; and
“(6) That at the time of the petition, the spouses have been separated in fact for at least one year and reconciliation is highly improbable.

panu po kung wla s mga yan ang ground to file this case? pwde po bng ifile ang case just bcoz we both partner agreed na wla ng hatian s maipproduce ng bwat isa? i mean gusto n lng nmin na ang kanya ay knya- at ang akin ay akin lng... bale ung maipproduce ng labor nmin will goes to the name of our childrens name...pwde kya un?
