What is the due process in Transferring land title from deceased parents to Children

Hi Admin,

Good day!

We would like to ask of what is the due process in transferring the land title from parents (named under the couple) to their three children which aged 11, 9 and 6 years old.

Parent of the children were killed.

The proper procedure should have been to file first judicial settlement of the estate (judicial or extrajudicial) and register thereafter but the children are all minors. A petition for guardianship over them and of the property should be filed first in court and the appointed guadian shall process everything for them.

Hi Filia,

So, would that mean after the guardianship petition has been granted, transferring of assets can be done and process the land titling to the children even if they are still minors? Or they should reach the legal age first (is 18 years old is the legal age in the Philippines) before they can acquire the assets?
