Good day! Bumili po parents ko ng lupa, ang usapan nila ng owner, 50-50 ang bayad. 50% first payment (after deed of sale) 50% after maasikaso ang titulo ng lupa. Pumayag po ang both parties. Naibigay na po ang deed of sale and the 50% payment. Pero ang nangyari, nagrequest ng nagrequest ng pera ang land owner dahil kailangan daw nila ng pera. Hanggang sa umabot sa point na almost 75% na ng full amount ang naibigay sa land owner. Ngayon, humihingi na naman po ng pera yung land owner, so ayaw na magbigay ng parents ko ng pera since may usapan sila. Nagalit yung land owner at ang sabi, sila na daw po muna ang kukuha ng rent ng mga establishments sa lupa since hindi pa full paid ang lupa. (Ang usapan po nila dati, after the first 50% payment, parents ko na ang kukuha ng rent). Ano po ba ang legal actions at the right thing to do with this matter?

I would also like to add, na more than a year na po ang nakakalipas na naibigay ang deed of sale at ang 50% payment. They were trying to get money every now and then kaya 75% paid na yung lupa. Hanggang ngayon, wala pa din pong titulo.

May right pa po ba ang land owner na kunin ang rent ng lupa kung may usapan na sila ng parents ko dati?

Valid ang stipulations ng both parties, and there is nothing wrong with the initial agreement of your parents and the landowner in getting the paid rent from the lessees of said place.

The contract of sale was agreed upon by both parties, there is valuable consideration present, and the property is the thing that is being sold.

Since wala naman sa usapan na mapupunta yung right to acquire the rent sa landowner kapag hindi nakapag-advance ng bayad yung purchasers (your parents), ibig sabihin ay illegal yung ginawa nung landowner. Ang pwede nyong isampa na case ay breach of contract of sale, since clear naman na 50% ang downpayment and the rest shall be paid upon the proper transfer of ownership sa land title. Gratuitous yung ginawa ng parents mo in helping the financial woes of the landowner through the requested advancements, pero inherently wrong yung ginawa nya na nagalit sya and kinuha pa yung paid rents ng mga lessees sa property dahil di nakapag-advance.

I highly suggest that you try to seek mediation muna bago magkaroon ng full-blown case against the landowner, since expensive yung litigation process in itself. Baka naman kasi madadaan pa ito sa mabuting usapan with the help of a neutral 3rd party mediator in guiding both parties towards an amicable resolution.

Good luck in your current situation. Keep every receipt or any other documents that may be used as evidence in case this becomes a full-blown case in court.
