Hi,

I have a dilemma let me put this in a lawschool type question.

A, B and C extrajudicially settled a parcel of land left to them by their deceased mother D in San Pedro, Laguna whose spouse died many years back before her. A and B waived their rights in the said extrajudicial settlement in favor of C, subsequently B died. C now trying to sell the land found an issue in the date of death of their mother appearing in the Extrajudicial Settlement of Estate they executed ( Feb. 14, 1997 ), in the publication Feb. 14, 1997 ( newpaper ) and original death certificate ( Feb. 13, 1997 ).

1. What are the remedies of C?
2. Would the issue affect the sale of the property?
3. What are the legal implication if the sale would push through?
