My mother in law is 81 years old. Her husband passed away and remarried. Her 2nd husband is now 55 years old and is a seaman. She have 3 children in her first marriage (are no longer staying with her) and an adopted daughter on her second marriage who is now 19 years old. She kicked her daughter out of the house for physically abusing her and harassing her for money. About a month ago, my mother found video tapes of her husband having sex with her adopted daughter. The video tape was taken when their daughter was just around 12 to 14 years old. My Mother was so upset and felt betrayed. Her husband is coming back to Philippines on the 20th September 2014. She wants him to get arrested and get charged for child pornography and pedophile. He is unaware of what my mother had discovered. We are so worried and fear for her safety when he comes home. Please advice, legally, what must she do and also how are they going to settle the ownership of their property.

the complaint must be filed at the prosecutors office of the place where the crime was committed. punta po kayo sa justice hall sa lugar ninyo, usually nandun po ang office nila.

More importantly,  PAANO natagpuan ng Mother mo ang videos?    Kung ito ay inadvertent.. go mag file ng kaso.. pero kung ito ay hinagilap ng walang permiso sa may-ari  ( for instance nakatago sa de-susi na drawer or steel cabinet)  YARI KA di mo pwede gamiting ebidensya sya..  isep isep muna bago mag file sayang ang filing fees at appearance ng abogado.

Video is video it speaks louder than words! No matter how they produce it, it will be valid in court!

Ano ang laban ng Mother ko sa kaso kung consensual sex? And by the way, itinuro ng bata kung saan nakatago ang video tapel.

12years old and below, statutory rape. sabi ng batas, a minor 12yrs and younger is incapable of giving consent. so kahit sabihing consensual, rape pa rin yan. 12-18years old with consent, pasok yan sa seduction. pasok din yan sa RA 7610 o child abuse kahit na consensual pa yan. patong patong na kaso ang haharapin nyan.

Prosecutors are required to resolve complaints within ten days after receiving the affidavits of both the complainants and respondents (Rules of Court, rule 112, section 3[c]), but in reality it may take months or even years to do so. Baka natabunan na ang kaso. Magfollowup ka na lang in writing.
