Good Day! Gusto ko po sana humingi ng advice regarding Child Support..
My daughter is already 3 years old. Naghiwalay po kami ng father ng anak ko 2 months after ko manganak, after po nun wala ng communication or sustento..

When my daughter turned 2, bumalik po yung father nung anak ko at aayusin daw namin ang relasyon namin, tinanggap ko siya dahil nakita ko sa anak ko kung gaano sya kasabik sa daddy nya.. After 3 months, nahuli ko po na my ibang girlfriend yung father ng anak ko, nakipahiwalay ako dahil mas pinili nya yung babae kesa samin.

We are both working in a BPO industry. He is now a product trainer. Nais ko po sanang mag demand ng child support since my daughter is going to school by next year. Hindi po kami kasal pero acknowledge nya yung bata, gamit ang last name at naka pirma sa birth certificate. Nais ko po sanang malaman kung paano ang magiging process ng ganitong issue?
wala po kaming contact sa isat isa pero alam ko po kung saan sya nakatira at nagtrtrabaho.


  • Ano pong pupwedeng legal na gawin pra maubliga syang magbigay ng sustento?


  • Dadaan po ba kami sa hearing? Papano po kung hindi nya pansinin ang dinedemand ko, ano pong mangyayari?


  • ppwede po bang mag direct ako sa HR ng opisina nila? (ang sabi po kasi ng kaofficemate ko, kapag my mga legal papers ako na ppwedeng ipakita, ppwede akong lumapit sa HR ng opisina nila at iuubliga na bawasan ang sahod nya, papano po ang tamang proseso?)

Mag file ka ng criminal case under RA 9262 under economic abuse.

Pwede kang lumapit sa abogado para gawin ang complaint mo at i-file sa Prosecutor's Office, o di kaya, pumunta ka sa Women and Children's Protection Desk kung saan bayan ka nakatira at isalaysay mo ang reklamo mo. Kapag nai-file na sa Prosecutor's Office, dadaan kayo ng Preliminary Investigation. Kung hindi siya sisipot sa PI, mas malamang na sumampa ang kaso sa husgado. Kung sumampa na, mag-iissue ang Judge ng warrant para sa kanya.

Kung nakapag-file ka na, hindi na dapat mong dalhin pa sa opisina. Kapag naobliga mo na siya sa pamamagitan ng compromise o desisyon, saka mo siya dalhin sa opisina.

salamat po sa reply at advise. gusto ko lang po sanang malaman if magbibigay ng sustento ang ama, may karapatan po ba siyang heramin ang bata? o kailangan din nyang mg file ng visitation rights?

(natatakot po kasi akong ipaheram sa kanila yung bata, dumating po kasi sa point na gusto nila heramin yung bata, pero nalaman ko na hindi na po nila ibabalik sa akin at itatago nila sa laguna)

Ppwede din po ba akong mag file ng abandoment kahit hindi kami kasal?

it is the basic right of the father to see and visit his child. if you will deny that, maari siyang mag-file ng petition. abandonment is not possible, hindi kayo kasal. but petition for support is possible.

salamat po sa reply. karagdagan tanong lang po.. almost same scenario with my colleague, ang pinagkaiba lang po namen is ung tatay po ng anak nya is kasal sa ibang babae, pero hiwalay na sila at ung lalake ay my kinakasama na rin na iba.. wala silang anak sa asawa nya, dahil my deperensya yung babae. ngkaroon sila ng anak ng kaofficemate ko at hiwalay na.

since kasal po yung tatay ng anak nya sa iba, my karapatan pa rin po ba syang humingi ng sustento, acknowledge at nakapirma rin sa birth certificate?

Good am Sir/Ma'am, I would like to seek help on how I can legalize the financial support of my kids. I have been separated for 6 years now and I am really finding a hard time getting financial support from my ex husband. I have two kids, one is 16 yrs.old and the other is 8 yrs. old. I brought this case to our Baranggay last year and fortunately my ex husband, gives us financial support of Php10k a month. However, there are months that he keeps on giving alibis wherein we ended with no support at all.

I remember him not giving us 2 consecutive years of financial support, then after a while he just popped out and provide his Php10k support per month. Every month is a stress month for me. I need to email him, text or even call him just for the support. Most of these times, I cannot contact him because his cp is turned off and even can't reached him in the office due to meetings. I really need your help on the concern. I want to put everything in papers so that I will no longer talk to him and once we've settled this, I can file for legal separation. Thank you so much for your help.
