sa mga nababasa ko po dito ay civil case damage lang ang pwedeng ma ifile kapag ang asawa ay nangaliwa at di aplicable ang concubinage. tanong ko po where can this be filed, are the evidences like fb photos of them together and testimonies that they are seen together enough to file the case? kapag nabuntis po niya ung mistress niya ibang kaso na ba yon?

such a case can be filed in court. if less than 100k, a small claims case.

it depends on what those fb pics will show, but hopefully the testimonies you will present will be enough.

oh, in a recent decision, the supreme court ruled that both the husband and the mistress can be charged with ra 9262 under the theory of conspiracy.

can this case be filed kahit matagal na nangyari??should the evidences be recent or malapit sa date ng pagfile ng case?? can this be grounds for annulment or legal separation lang?

if you can prove that they are living together, then you can charge them with concubinage. if the infidelity is repeated, then you can charge them with ra 9262
