I have been working to a private company for 2 years. i just file my resignation after the 2 years, then i comply all my clearance to the office to receive my back pay in two months. I was working on an new company which is a competitor of my old employer. i keep it secret so that i will receive my back pay. then my previous company learn that i am working with them and they said they will get a hold of me coz in the contract they said i am not allowed to enter for work to any competitor for 2 years. how ever they never gave me a copy of a notarized contract, i remember signing a non notarized contract since i got regular after 6 months of working with them. yet i always follow up on them for my copy till i got resigned i haven't got one. will the contract still valid? and will they sue me for i work on the competitor? what kind of actions should i take in order for me to avoid complications? will i be able to get my back pay? should i resign to my current employer and look for a new work? hope you could help me. Thank you

Sam, the contract is valid, but if they do sue you, you can argue you were not given a copy. however, this detail about you keeping it secret tells me you knew that there was a non-competition clause

bodey, i would consider that as a diminution of benefit which is not allowed.
