Hi,

I am a monthly paid employee with a 261 days computation for daily wage.

If a Legal Holiday falls on my rest days (Saturdays or Sundays) which are unpaid based on the 261 days computation, Am I entitled to an additional 1 day pay for such scenario?

Please advice. Thank you.

Thank you very much for the update, attyLLL.

My employer reasoned out that because 261 days already includes Legal Holidays, it is deemed as paid even if it falls on my rest days.

Can I file a labor case for this with the DOLE? And will DOLE favor my side?

Please advice. Thank you.

Sorry, i thought this over again. you are not paid for weekends, but you are paid for holidays. consequently, if a holiday falls on a weekend, it is already paid.
