Dear Legal adviser,
My brother had an illegitimate daughter 6 years ago here in baguio city. The mother left my brother taking with her their daughter and was never heard since then. recently she got in touch with my brother using facebook and threatened to sue him for child abandonement. we foundout they are
living in rizal province.my brother acknowledged the birth of the child but they didnt marry.
Can she really file for child abandonement againts my jobless brother who has a family of his own now? my brother and all of us in the family never heard or knew the mother and child's whereabouts since it was her intention to dissappear from us. and now she wants tofile for child abandonement.is it possible on her part and what are the legal grounds?

help your brother send some money regularly, whatever amount he can. P2,000 would be a good number to support his child.

Thanks for the quick reply attorney but i think i didnt explain the situation well. money i guess is not a problem since the child's aunt and grandma(my sister and mom working in the U.S) both wanted to send money and gifts for the child but we couldnt find them since she really wanted to have nothing to do with my brother and us. By the way the mother of my brother's child is an Irish citizen and have been diagnosed with manic/depressive disorder which gave her the delusion that we wanted to separeate the child from her,which explains why she ran away from us. now with my brother married, she suddenly appeared in facebook threatening to file for child abandonement and said the case is already filed. tell me attorney, is this possible when she never demanded support and shied away from from us all these years while voluntary support is ready if only she kept in touch? what are the legal grounds before filing for child abandonement or when and what circumstance does a single mother have to file for child abandonement? thanks somuch attorney andstillmore power.god bless

please differentiate between filing of a case and whether the case will prosper. there is no stopping the mother from filing a case.

have your brother prepare his affidavit along with all supporting affidavits of his witnesses.
