Namatay po yung mother-in-law ko. After po ng libing, natuklasan po namin na madami palang naiwan na utang amounting to 4 million in total. Karamihan naman po sa coop/bank and inadvise po kami not to worry since meron daw insurance na sasagot sa utang. Pero meron pong nautangan na loan shark. Bale 100k po yung utang na naiwan with PDC amounting to 130k. Hindi po niya pinaliwanag bakit me 30k. Ang iniisip lang po namin, kung bakit me kasama ding titulo ng lupa as collateral, eh me PDC na po.

Araw-araw po siyang tumatawag. Pag kinakausap po niya kami eh me pagkabastos po ang dating. Sinabi po kasi na namin na hindi namin expected na ganun kalaki yung utang. Sinasabi pa na nagpapaawa kami. Talaga pong hinaharass na kami.

Question ko po is, me karapatan po ba kami na bawiin yung titulo ng lupa ngayon. kasi feeling po namin kaya kami hinaharass eh dahil gusto niya kamkamin yung lupa. Meron po ba siya right na ibenta yun since me pdc siya?

Second po. Pano po ba namin siya pipigilan na harassin kami. Me right po ba siya na idemand sa amin yung payment? Since patay na nga po yung umutang?

so the person is holding a copy of the title? check at the register of deeds if there is any annotation of mortgage. there is nothing wrong with giving both pdcs and the title if the parties agreed to it.

her remedy should be to file a collection case against the estate. if you want the title back, then you have to pay for the loan because there is a valid deposit of the title as collateral.

if you receive properties from your aunt, she can run after you to the extent of what you received.
