We would like to make an inquiry regarding the legality of the terms and policies of Cardprints Philippines particularly their cancellation policies.
This is their policy as shown via their official website:
Cancel Orders
You may cancel your order with a charge fee of P2,000 ($40) if cancellation is made on the same day of ordering or the first hour of the following day.
Beyond the specified time period, an additional minimum of P400 ($ will be charged for the preparation of the layout. If we have already purchased the materials for your order, the total cost of the materials +30% will also be charged. The purchased materials will be shipped to you and the shipping charges shall be on you. The 30% additional charge shall cover for the administrative cost of the said materials.
No refunds are made upon confirmation. You may claim refund or chargeback to your credit card in four weeks. If your payment is in check form, they must be cleared first with the bank before refunds may be issued.
Returns and Exchanges
In order for us to keep our prices low, our items are shipped directly to you. Therefore, all sales of unprinted items are final. No refunds or exchanges.
We shall replace all products at no cost if we fail to follow all specifications made on the placed order. However, if you may have overlooked their specifications including but not limited to typographical errors in the layouts, we offer 50% discount on the reprinting. The replacement processing time is minimum of one (1) week depending on the complexity of the job.
Your complaints must be addressed to us within five (5) business days. If a representative is sent to file a complaint, you must send a letter of authorization, or send an SMS or “text” to our office regarding authorization or call us directly for the complaint to be honored. For a complaint to be valid and to merit replacement, you must return the products to us. If you wish to retain partial number of the products, we shall only replace equal to the number of returned products.

We wish to clarify their refund policy as they mentioned that there is no refund allowed yet had the sentence "You may claim refund...." In the contract we signed, the claiming of refund did not say anything about credit card payment. Therefore making us think that it is applicable to all kinds of payment. They insisted that the no refund policy only applies when there is no 'confirmation'. However, we wish to debate that the job order contract cannot serve as 'confirmation' considering as it also served as the official invoice for our down payment. With the way the transaction with them is handled, if the job order contract serves as confirmation, then all kinds of initial down payment are considered confirmation, thus rendering a refund policy useless and impossible.
We've been discussing things with them for days but they kept on insisting on their P2, 500 cancellation charge. The fact that the money we wish to be refunded was a mere P2, 000 made their policy all the more unjust in our opinion.
What can we possibly do?
