Good pm, I am separated for 10 years. My husband left me and my 2 children without any support at all. 4 years ago Ive learned that his mistress got pregnant and he named the child under his name, was able to get the birthcert of that certain son of him but that kid died years ago. Recently I have learned that he named another kid again and the mother is the new mistress that he have. Now she and the son is living in the place where we got married. I have secured the birthcert again of that kid and photos of the baptismal and all picture that was taken in that place. I just want to know what can I do about this? I have asked him to settle this matter with annulment since there is nothing to fix and he is now living and supporting the said mistress. But he refuses and says that he only got married ones. But he wouldn't give up the mistress. What can I do about this? He's making our life miserable, he never supported us and he wanted to hold us, especially me. I don't know what he is up to. My children is not using his name and I am not demanding for any support. Just I want our marriage to be annulled so that he can have his own life and with me that I am not tied up to someone who is useless at all. What for that I will be holding on when he made my life so miserable even at this point of time. I am working abroad and I am afraid that he is holding on to me to get something if something happens to me. I don't want that what I will have in the future he will claim for it. I want to protect my children from him, my investment and property.

Please advice what is the best thing to do, can I place a complain against them?

Thank you.

Yes, I had asked him already twice to do the annulment. When I have learned about the first lady giving birth, I told him better to settle with her and just file the annulment. His answer was, he will not file the annulment if I want them I have to spend for it. This second time, I had asked him again since he had another lady again and another child with him, he refuses for this settlement again he told me that he only married ones and he is better off that way living in with another woman when he doesn't know how to free me. I am not after to file a complain but if its the only way to end this things that he is doing I will do it. In any other way, I just want to get rid of him and free myself. I have been suffering from this unfaithful deeds of him for 10 years. I have solely face the responsibility to our 2 children, now I don't want him to grab any opportunity with me in the future. I cannot settle myself. I cannot buy property, everything in my life is in threat of him. I want to give him a lesson for what he is doing. My children are not small anymore, I don't want us to be having this kind of miserable life.

you can file a petition for annulment in court. here are the grounds: http://www.pinoylawyer.org/t4792-grounds-for-annulment-declaration-of-nullity-legal-separation-and-separation-of-property

or you can file a complaint for economic abuse at the prosecutor's office. send him a demand letter first. but this will not affect the status of your marriage.
