There is a complaint regarding this guy who owns a resort, Inside the resort he has a private house, there were four female persons ask the owner if they can use his private comfort room then inside the comfort room they saw a hole, when they check that hole it has a mini camera in it. They called for police assistance complaining the owner of the resort, when the police officers came in the area without a search warrant they confiscated these evidences including the TV, Camera,cables and other gadgets used in video taping.They brought the owner and asked to run the said tape when played there were no recording of it. They did not inquest the owner a few days these female complainants came back at the office a wanted to file a case of regular filling Republic Act No. 9995 – Anti-Photo and Video Voyeurism Act at the provincial prosecutor's office. My question is it legal to used those confiscated evidences without a search warrant and confiscation receipt? They just made a confiscation receipt that says REFUSE TO SIGN by the owner by the police officers. Can the owner of the resort can charge those police officer who made the case?
