Good Day. I am asking for legal advise about my situation. I am 1 year and 3 months in my company right now and currently 6 months pregnant. My probationary contract expires last Feb.2011 and I didnt received another contract for my regularization. Last Sept.31,2011 Hr informed me that my employment will be terminated effective Oct.31,2011, I asked a memo but she told me the best thing to do is just give them Resignation Letter so that I can get a Certificate of Employment. , I asked for my grounds of terminating me, she just told me it's based on my assessment for the year. She promised to give me one month separation pay aside from my back pay and 13th month pay, Do you think it's just right for me? I am feeling force to resign because I need my certificates for my sss maternity claim,she said it will be a bad record if they terminate me that's why she is offering me to resign as if I don't have a choice, I am feeling under pressure? Is it right thing to me do? Can I ask them to give me 2 months sep. pay instead of a month pay because I am pregnant and I cant find work because of my situation?

I am a medical practitioner. I'm sorry if this is unsolicited. Please do not stress yourself so much. You are in your second trimester. This is the period wherein your bb can actually feel you.

But I hope you will find the courage to fight for you and your child's right. This is the one gift you too can impart to your child, aside from the gift of life.

Thank you all of your concern, I talked again with our HR and clarify my grounds why they are terminating me , she just told me that if I cannot give my resignation letter that is needed for my clearance then I will be terminated due to redundancy so my husband decided that it,s just best for me if I will be terminated than being forced to resign at least I am sure that I will get my separation pay rather that just a verbal agreement that if i will be resigning they will give me that benefit.

comment lng po, base from experience takot nmn tlga ang mga kompanya n yan mgterminate ng employee kaya lagi nila cnsbi n mgresign n lng pra ndi masira ang record, pero ang totoo ndi nila kaya mgterminate ng employee. tested ko n yan sa isang international company n pinasukan ko, bngyan ako ng 3 days suspension at ndi ako pumayag or pumirma instead hiningi ko termination, at ndi nila mbigay. Pero nkahanda nmn ako mgfile ng case kng sakali n termination ang gagawin nila which is plgay ko alm ng kompanya yun. Advantage kasi s gnun pwede mo pgkaperahan yng kompanya lalo n kng manalo k sa kaso, disadvantage lng kakain ng panahon at oras sayo. pero eventually ngresign n ko sa kompanya n yun at nsa mas maganda ako n kompanya.

question lang po, bakit po ayaw nila magterminate? dahil po pagkakaperahan pano po yun? sorry noob questions

Tama po kayo dyan, hindi nman ako bnigyan ng memo about terminating me due to redundancy, verbal lng ako kinausap, they already processed my check and will give it on my last day, nkalagay sa clerance me resigned, they give me one month sep. pay aside from my backpay.
