Need advice. I went to a TV station for help with a complaint about noise from a restobar in Quezon City. The TV station interviewed me then aired the report. The restobar was served a cease and desist order by Quezon City. I then went to the USA to care for my sick father for 7 months. Upon my return I became aware that a libel complaint was filed against me, the reporter, and the tv station in Quezon City. I was not served a summons since I was out of the country. I obtained a copy of the subpoena. I attempted to get help from the TV station, they provided me a recommendation letter for the Public Attorneys Office. I'm certain everything I said in the interview is true, as to what the reporter said I'm not sure. The case was filed in May 2011, I returned September 2011. How do I obtain the full details of the complaint's affidavit so I know what I'm being sued for? Can I still file a counter affidavit? How much will it cost to file a counter affidavit? If I were to get an attorney, what would the range of fees be for this kind of case? Thanks

Spoke to PAO QC, they had me check for verification at records, reply was not yet resolved. Spoke to fiscal and asked for copies of paperwork. She refused to give me any papers unless I file a motion to reopen the case, since I had missed the hearings, even though I was unaware since I was out of the country. Should I reopen the case inorder to file my counter affidavit or should I just wait for the resolution?

no harm in following fiscal's advise and just ask that the case be reopened. and attach your counter=affidavit to the motion by requesting it be admitted. its an obvious harassment suit. i also would advise you follow up the closure of the restobar with the qc hall.

Just came from the IBP. Explained the case and they seem to agree that my case is meritorious, but they won't represent because they don't believe I can't afford an attorney. They also suggested I file to reopen. Since I have no money, I'm thinking of just waiting for the case to be resolved. If it's dismissed no problem. If it isn't dismissed then I'll be given a PAO for my case, but I might need to post bond. Unless I can find an attorney willing to do the motion to reopen/counter affidavit pro bono or installment payments.
