Hi, I am married and my wife has two kids
from previous relationships.

We went to NSO and the first kid has no
record of birth certificate with NSO.

The birth certificate in her possession
shows the name of the father X, but the
natural father (according to the wife of
course)is Y.

Can I file for late birth registration and
put the kid on my name (give it my surname) ?

Thanks for any advice.

don't, that's simulation of birth and is considered a crime.

Thanks for your prompt reply.

But the NSO document (negative certification
of birth) states : Otherwise, any interested
party may apply for delayed registration.

As legal husband of the mother, doesn't that
make me an interested party ?

So what should my wife put on the birth certificate ?
The name X which is on the original local birth certificate
(not registered with nso), which I assume would also be
simulation of birth,
or the name Y of the biological father who has never
seen the kid ?

she can leave it blank. the father won't be listed anyway unless he signs it.

Again, thanks for your prompt reply.
Can she change the kids name on the birth certificate.
Currently the kid has the family name of X, the non
biological father. Can she change the family name to
her own family name ?
Would this have many implications ? As far as I know the
only important thing currently is his school card, but I
might be wrong of course.

On a separate note, I have a friend living in Singapore
who got married to a Philippino lady last month. She has
a daughter from a US citizen. My friend wants to adopt the
girl in order to bring them long time to the EU. The US
father has indicated by e mail he has no objection to this.
Could you recommend a budget friendly (my friend does not
enjoy a big income in Singapore) adoption lawyer for this.

i recommend they find a way to bring the child to the US and then adopt her under US law.
