But to answer your question, Gina's marriage is VOID and is not legally binding. For a marriage to be valid, it is imperative that all the essential and formal requisites are present. And one such essential requisite is that both parties must be of legal age, i.e. 18 years old or older.

FORMAL REQUISITES OF MARRIAGE:
1. Authority of solemnizing officer
2. Valid marriage license
3. Marriage ceremony where the contracting parties appear before the solemnizing officer, with their personal declaration that they take each other as husband and wife in the presence of not less than two witnesses of legal age

Absence of essential or formal requisites – marriage is void ab initio. Ibig sabihin e wala pong bisa ang kasal at di na pwedeng gamutin ang depekto ang kasal kahit dalhin pa ang marriage cert sa NSO.
