simple seduction is committed if the following elements are present
1. That the offended party is over 12 and under 18 years of age;
2. That she must be of good reputation, single or widow;
3. That the offender has sexual intercourse with her; and
4. That it is committed by means of deceit.

what if the only present element is that she is a minor? and sexual committed without deceit? because of the boyfriend-girlfriend relationship? (as what happened is "pagtatanan")?

ARTICLE 343. CONSENTED ABDUCTION
ELEMENTS:
1. That the offended party must be a virgin;
2. That she must be over 12 and under 18
years of age;
3. That the taking away of the offended party
must be with her consent, after solicitation
or cajolery from the offender; and
4. That the taking away of the offended party
must be with lewd designs.

Though the case have been filed, the minor (girl) have been turn over to the DSWD twice because of her insist to live or be with the guy who cant resist because of his love to this girl. would this help or would this have a weigh to acquit the accused?

In consented abduction, the taking away of the virgin must be with lewd design. Actual sexual intercourse with the woman is not necessary. However, if the same is established, then it will be considered a strong evidence to prove lewd design.
