Ako po ay nag-resign na sa isang kumpanya. Para po makuha ko ang last pay ko, kailangan ko po pumirma ng Quit Claim and Realease Waiver dahil requiremnt po ito ng kumpanya. Na-deliver at cleared na po ako sa mga deliverables kaya gusto ko na kunin ang huling sweldo ko. Ayoko lang po sana pumirma ng Quit Claim dahil may ilang issues po ako sa kumpanya na balak ko sana i-file eventually sa NLRC. Pwede po ba ako hindi pumirma sa Quit Claim? Paano po kung magmatigas ang kumpanya na hindi nila ire-release ang huling sweldo ko without signing the Quit Claim? Kailangan ko po sana ang huling sweldo ko. Pero ayoko lang po talaga pumirma ng Quit Claim dahil sa ilang issues ko sa kumpnya. Requuirement po ba sa batas ang Quit Claim Waiver? Paano po kung sabihin nila na requirement ito ng kumpanya for my last pay to be released? Ano po ang pwede ko gawin?

if i were the lawyer of the company, i would not release your last salary unless you sign that quit claim.

Ano po ang pwede ko gawin? Tulong at suggestion po sana ang kailangan ko. Hindi ko po alam kung nangaasar kayo. Pero seryoso po sana ako na makahingi ng payo mula sa inyo.

oh, i'm being serious. you have to choose between receiving your last salary and filing a case at nlrc. a quit claim is standard precisely to avoid further claims from an employee. they can use it against you if you file one anyway. the company would be exposing itself to risk if they didn't request you to file a quitclaim.

if you will refuse to sign the quitclaim, your remedy is to include your last salary as one of your claims in your complaint at nlrc.

Hi attyLLL,

How about my case?
I was not given a clearance ksi ayaw pirmahan ng visor ko.
Kaya wala din akong napirmahang quit claims.
Can I demand a money claim at NLRC?So that my previous company will release my 13th month pay at tax refunds?
Please advise me what to do.
