Hello Members,

Can i refuse to sign a quit claim and still get my backpay?

The company that i worked for suddenly terminated my 2 year contract. my contract is supposed to expire in April 2018. The termination is quite unfair so i am planning to file a case against the company. but i waited for the backpay because i want to see if they will give me credit for my work. just yesterday they sent me the computation and i am furious that they did not give me even a peso for incentive.

The company won't release your check / last pay if you don't sign the quitclaim.

how long can they hold my backpay? backpay is mandated by law right?

they will hold it till you sign. If you are planning to file a complaint, you should include that (non-payment of final pay)

File a case then tackle the issue regarding back pay before the hearing
