dear anybody who can help me in this site,

Please help, I need it badly. I have a 2 lots adjacent to my sister's lot where our house is constructed and it's now our residence. I found out that my sister loaned it to a private person including the 2 lots in my name forging my signature in the deed of real estate mortgage documents sometime in year 2000. In year 2003, I received a petition for extra-judicial foreclosure of real estate mortgage, me and my sister as respondents. The loan obligation obtained by my sister is five hundred thousand but as of last year it's already more than 6 million which include interests. We have no other means to pay that obligation. It's now in the court, waiting for the decision. Yesterday, I was informed that the petitioner asked a record of my total landholdings to our assessors office. I have no knowledge what's his purpose or planning to do. My question is, is it possible that my other properties could be affected or be taken as payment to the loan which in fact my signature was just forged? The petitioner and our lawyer have no knowledge yet that it was a forged signature. I don't want also that my sister be convicted for forging such but i am so afraid that my other properties be taken as payment to that loan. Please help, what best act should I do?

you should discuss this with your lawyer. he has better understanding of your situation.

is it right to seek an advice from another lawyer, my own lawyer? am shy revealing it to our lawyer that my sister forged the deed of real estate mortgage, by the way, it's my sister who hired our present lawyer, and I guess that lawyer have no knowledge on the falsified deed.

your shyness will cause you the loss of your properties! do you mean the defense of forgery was not raised as a defense in court?

if you are a respondent in the case, and the lawyer represented you, it may be too late. but if not, you can still intervene in your own right with your own counsel. but yes, you can discuss this with another lawyer.

yes sir, i'm one of the respondent in the case, and the defense of forgery was never raised in my sis lawyer's defense, i never told it to my sis lawyer because i know the consequences, my sister will be jailed for doing it. my only concern now are my other properties. I'm ready and can accept the foreclosure of the mortgaged properties but not my other landholdings. Maybe, I can ask recomputation of the interest of the 500 thousand loan? i guess the 6 million being asked for the payment of the loan is too much. they charge 2.5% per month on principal and was never stated in the deed that it is compounded monthly. please help me decide sir?
