Ang kapatid ko na maysakit ay may 1 anak at 1 ampon. Asawa ay may kinakasama at hindi siya suportado sa gamot at health foods. Tumira sa 1 apart unit ko na nasa labas upang makapagtinda for her own support. Pinag-aral ng kapatid ko ang 1 anak. Ako ang nangolekta ng upa sa dating bahay upang ipambayad akin ngunit hindi sapat na makabayad dahil commercial ang unit na pinagamit ko. Ang repairs na ginawa ng asawa ay hindi namin alam at nakaperwisyo pa sa amin. Kuryente at tubig ay hindi nagbayad for 18 years. Umabot sa P170,000 at ang Meralco ay mas malaki pa. Binayaran ko ang NAWASA at pinaayos ko ung Meralco. Ung realty taxes ng lupa nila ay binayaran ko para hindi masubasta dahil 10years silang d nakabayad.
Hiling ng kapatid ko ang bahay upang may kita siya at pera sa gamut. Dahil sa pagmamahal ko sa kapatid ko, ipinagawa ko ang dilapidated na bahay sa lupa na binigay sa kanya ng aking magulang. Ang title ay nasa pangalan niya married to Albert ( ung asawa). Pinirmahan ng kapatid ko at ng kanyang anak ang promissory note with real estate mortgage ngunit hindi alam ng asawa kaya ang prom note ay nakalagay na abandoned sila. sa paniwala na hindi na siya babalikan dahil sa may sakit at ang anak naman ay dalagang ina na may kinakasama. Ang purpose ng prom. Note ay 2 lang: 1. To support the medicines n health foods of my sister 2) To pay their obligations to me.
Pumunta ako sa States na may umuupa na sa 2 door apart na pinagawa ko pqrq sa layunin na nasabi. Ngunit hindi siya inasikaso ng anak at ang collection ng apartment ay kinukuha at hindi naasikaso ang kapatid ko hanggang sa namatay. Mula ng mamatay ay kinukuha ng anak ang renta para sa pansarili. Almost 1 year hindi nakabayad sa akin kaya
Nagcomplain ako sa barangay ngunit hindi sumipot si Albert dahil ayaw niyang pa anotate ang title.
Sa ngayon nakatira ung anak sa isang pinto ng apartment and ung 50% binabayarn niya na may playa.
Question: Dahil 2 lang ang layunin ng construction ng apartment dapat bang kunin ni Heidi(anak) ung dapat na share ng kapatid ko dahil patay na? Hindi ba dapat bayaran muna ako dahil wala naman akong intention na tulungan siya. May sarili na siyang pamilya at ang utang nila ay nagsimula sa kapabayaan ng asawa na si Albert.
Nasa Prom note ay 50% for my sister & 50% to pay me.

The property is in the name of my sister married to the name of his husband.
Ang pumirma ng promissory note, my sister ( who passed away) and her daughter.

Actually I want to send the prom. note but it has to be confidential.

Kung patay na ba ng principal debtor pero buhay pa ung comaker, pwede bang reform ang promissory notes for its defects?

Noong binayaran ng parents ko ang lupa, ay dineretso na nila ang deed of sale sa kapatid ko married to name of husband. Hindi namin alam na ang husband ay gagawa ng kalokohan, may babae at hindi supported ang family, maraming utang sa amin at maraming perwisyong ginawa. Question: Pwede ba namin paanotate ang title sa mga ginawa niyang utang na pirmado ng anak at ng kapatid ko noong iniwan niya ang kanyang family? Unfair sa amin ang ginagawa dahil ngayon ay nagpatayo pa siya ng bahay for rent para siya kumita sa lupa na pinamana ng parents ko

the co-maker will be equally liable if the estate of the principal debtor does not pay. what you can do is to file a complaint for collection, and if you win, you can execute against the property.

1. Who is authorized to appoint the administrator of a property whose principal owner died?
2. What are the qualifications of an admnistrator?
3. Who will appoint the administrator?

kung hindi nagkasundo sa barangay and then about to file a case but another offense was committed by the debtor, can we file another complaint with the barangay?

Can we appoint a third party to collect the rentals since the co-maker is not remitting payment correctly?

Do you mean that I will not be paid fully?
How is the division be made?

Regarding the responsibilities of an administrator of properties of the deceased, under whose supervision will the administration work. Are there guidelines to be followed so he would be guided on the legal means to handle the administration.

when i say the co-maker is equally liable, i mean for the whole amount. it is not split between them.

only the court is allowed to appoint an administrator.

what new offense was committed by the debtor? if it is unrelated, then a bgy case can be possible.
