Can petition for declaration of heirship be done separately, like filing it without having to ask for the settlement of estate? Jurisprudence tells that the jurisdiction to hear such action is vested only with probate or administration court. Can it be done separate from the administration proceedings? Thanks

Suppose I would institute a civil action for cancellation of old decree and re issuance of my great grandparents and because I wanted to establish that we are some of the heirs, we would like to have a court declaration that we are the heirs. I suppose it would be in a petition for declaration of heirship without having to file for settlement. Is that possible?thanks
