Slight Physical injury

Hi good day, Gusto ko lang sana mag ask ng advice re the case I filed last year. It happened last year 2010, nagtuloy tuloy po yung case hanggan sanaka receive ako ng schedule ng first hearing namin. Nun pumunta po ako, after nung first hearing pinagharap kami sa mediation center, pero walang nangyari kasi di nya kaya bayaran yung damages na nagawa nya, so nagtuloy pa rin yung case. When this case was filed, yun prosecutor ang nag file ng case, then nung first hearing may lawyer akong kasama. But something went wrong na ngayon wala na akong lawyer, malapit na yung next hearing ko. gusto ko lang sana ask kung pwede ba ako umatend ng hearing kahit walang lawyer? and anu po yun dapat ko gawin para makapagpalit ako ng lwayer? help me naman po, i need an advice before this month end coz next month na yung hearing ko. thanks a lot!

You can arrange with your first lawyer so that he will withdraw from the case and then either:

1. Not hire a new lawyer and coordinate with the prosecutor instead and ask him to represent you. Carefully and respectfully explain why you had a lawyer at first but have none now. The prosecutor is a free lawyer for the Philippines and for the private complainant(this is you).; or

2. Hire a new lawyer

Thanks a lot richard! nawala yung worries ko dahil sa answer mo, wala kc talaga ko idea pagdating sa mga ganyan kaso-kaso. Gusto ko lang talaga kc managot yung taong nakasakit sa akin kc khit nagharap pa kami sa korte ay di man lang makapag sorry at maamin yung pagkakamali nya. maraming salamat talaga. Last Question, if kakausapin ko yung prosecutor, cya ba yung nag file ng case ko? tama ba ako? if ever ba kakausapin ko cya sure ba yon na hahawakan pa rin nya yung case ko? hindi ba nya pwede tanggihan yon? salamat again and sana masagot ulit! Re: prosecutor
Yung prosecutor assigned to the branch where your case is filed takes charge of your case. Pwede kasing iba yung nag-file (investigating prosecutor) at trial prosecutor (prosecutor assigned to the court).
Habang ang kaso ay nasa branch kung saan sya naka-assign, hindi pwedeng tanggihan ng prosecutor assigned maliban lang kung may sapat na dahilan (example: he is related to the accused or was a lawyer of the accused before he became prosecutor, etc.)

Sure ba na tatanggapin niya? Basta's hindi siya disqualified kagaya ng mga example, tatanggapin niya pero magandang ipaliwanag kung bakit wala ka nang abogado. Kung sakali man na disqualified siya, siya rin ang magsasabi sa korte na disqualified siya kayat pwede niyang hingin na ma-raffle ang kaso sa ibang korte or magrerequest siya from their boss so that their chief of office will assign a new prosecutor for your case.

Good day Sir, Meron po ako interview sa canadian embassy regarding sa dati kong kaso nadismissed na last May 1994 dahil nagfile ng affidavit of desistance ang complainant.Ang tanung kopo paano ko maipaliwanag ng maayos sa Visa officer ang ngyari dahil wala napo ako copya ng Affidavit and counter affidavit, ang sabi sa court nadisposed na nila Last 2008 pa with the approval of the supreme court...ang naibigay lang nila sa skin ay court decision.salamat po!

Try obtaining a copy from the Procecutor's Office. They might have not yet disposed their copy of the desistance.

If none, get a certification from the prosecutor's office and the court to the effect that the records were disposed off on a particular date in accordance with the proper archiving procedure so only a copy of the decision is retained.
Attach that to the certified copy of the decision that you will present to the Visa Officer. Mentally prepare short and honest answers to possible questions of the VO.

If you feel you cannot ably explain to the VO, and you are in contact and already in good relationship with the private complainant, you can try getting a new affidavit from that private complainant where he/she will explain the circumstances that led to the "misunderstanding and what lead her/him to subsequently decided to withdraw the case against you".

At any rate, your goal is to convince the VO that you are a good citizen and you will not be a security threat or even be headache at the country you like to go to.
