Arresto Menor

I entered a contract for sangla-tira and had paid in full more than a month ago, but cannot move to the house because there is still a tenant who has not received the full payment from the house owner for his prevoius sangla-tira contract. I understood that our payment were appropriated by the owner to her other obligations that had matured and needed to be settled which has nothing to do with the unit that I entered a contract with. Can I file a criminal case against the owner for this? and what case?

for me, the best legal remedy would be a civil case for collection. if you file a criminal case, I have my doubts whether it will prosper.
